Lawney L. Rathman died on May 24, 2018; The East Half of the Southeast Quarter (E' /2SE' /4) and the Southeast Quarter of the Northeast Quarter (SE'/ <NE1/4) excepting and excluding that portion therof deeded to the State of Nebraska for public highway purposes in Section Twelve (12), Township Ten (10) North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska, and The Southwest Quarter of the Northeast Quarter (SW' /4NE1/4) and a 10 -acre tract in said section described as the North Half of the North Half of the Northwest Quarter of the Southeast Quarter (N' /2N' /2NW'/4SE' /4), and the South Half of the Northwest Quarter of the Southeast Quarter (SV2NW' /4SE' /4) and the South Half of the North Half of the Northwest Quarter of the Southeast Quarter (SVZN'Y2NW/4SE1/4) and also a tract of land in the Southeast Quarter (SE' /4) described as follows: Commencing at a point on the south line of said Section Twelve (12), 1362.4 feet West of the Southeast corner of said Section Twelve (12), where there is now located an iron shaft, running thence North a distance of 1345.65 feet to an iron rod, running thence East 16.5 feet to an iron rod, thence South 1345.65 feet to the South line of said Section Twelve (12), running thence West along and upon the South line of said Section Twelve (12) to the point of beginning, all of said land being in Section Twelve (12), Township Ten (10) North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska JIM C. RATHMAN, being first duly sworn upon oath, deposes and states that: 1. Lawney L. Rathman created the Lawney L. Rachman Revocable Living Trust Agreement dated September 8, 2016 (the "Trust ") wherein Lawney L. Rathman designated himself as the initial Trustee of said Trust, and Jim C. Rathman as the first successor Trustee and Jennifer J. Klanecky as the subsequent successor Trustee. 2. From the date of the creation of the Trust until May 24, 2018, Lawney L. Rathman served as Trustee of the Trust; 4. Upon the death of Lawney L. Rathman and pursuant to ARTICLE XII of the Trust, Jim C. Rathman executed an Acceptance of Trusteeship under date of May 36 , 2018, wherein he has accepted the Trusteeship of said Trust and agreed to administer said Trust in accordance with the terms of the Trust Agreement and the laws of the State of Nebraska; 5. The Trust is irrevocable due to the death of the decedent, Lawney L. Rathman and is in full force and effect; 6. Affiant Jim C. Rathman is currently serving as Trustee of said Trust and the Trust Agreement grants Affiant as Trustee all powers under the Nebraska Uniform Trust Code;
