f GRANT OF EA ,.F.MF.RJT �i7 a A� � n 1 V PETER KIEWIT SONS', INC., a Delaware corporation and successor in interest to Missouri Valley Construction Co., a Nebraska corporation, herein called GRANTOR, hereby grants to THE CITY OF GRAND ISLAND, NEBRASKA, a municipal corporation in Hall County, Nebraska, herein called GRANTEE, an easement upon, over, in, and through a curtain tract of land located in the southeast quarter of the northwest quarter (SE 1/4, NW 1 /4) -of Section (20), Township (11) North, Range (9) West of the of the 6th•P.M., in Hall County, Nebraska, more particularly described on Exhibit "A" attached hereto and incorporated herein by reference. TO HAVE AND TO HOLD the easement for the construction, repair, maintenance, replacement, removal and operation of an underground storm drain, including all necessary manholes and other related appurtenances, and the transmission of water and other effluents through said storm drain. GRANTOR further grants to GRANTEE: (a) The right of ingress to and egress from the easement over and across said land by means Of existing roads adjacent thereto, or by such routes as shall occasion the least practicable damage and inconvenience to GRANTOR: (b) The right to use such portion of lands, contiguous to the easement as may be reasonably necessary in connection with the construction, repair, maintenance, replacement, and removal of said storm drain and appurtenances subject to the easement; provided that GRANTEE, after completion of the initial installation of the storm drain and appurtenances, shall restore the surface as nearly as possible to the condition existing prior to such work, and GRANTEE, shall repair any damage done by GRANTEE on any subsequent entry onto the easement area. GRANTEE agrees to perform any repair or maintenance work necessary for the maintenance and operation of the above - mentioned storm drain, and Grantor shall have no obligation for such work after the storm drain and its appurtenances are
