Oct 31. 2019. <br />f, 0 After Recording Return To: NEDCO, 4445 S. 86th Street, Suite 200, Lincoln, Nebraska 68526 <br />TERMINATION AND RELEASE OF THIRD PARTY LENDER AGREEMENT <br />Lot One (1) Ashton Place Second in the City of Grand Island, Hall County, Nebraska.. <br />On 09/20/2011, at the request of Nebraska Economic Development Corporation, Equitable <br />Bank, as the Third Party Lender, executed a Third Party Lender Agreement whereby Equitable <br />Bank made certain representations and commitments with respect to its loan to J.C.D.H, Inc. or <br />its affiliates (hereinafter "Borrower "). The Third Party Lender Agreement was subsequently <br />recorded on 09/26/2011 as Instrument No. 201107141 in the Records of Hall County, Nebraska, <br />relating to real estate described as: <br />Since Equitable Bank executed the Third Party Lender Agreement, the Borrower has satisfied <br />its obligation to the United States Small Business Administration and Nebraska Economic <br />Development Corporation; which necessitates the termination of the Third Party Lender <br />Agreement and Release of Equitable Bank from its obligations under the Third Party Lender <br />Agreement. <br />Premised upon the foregoing, Nebraska Economic Development Corporation, as Attorney in <br />Fact for the United States Small Business Administration, an agency of the United States of <br />America and assignee of the Third Party Lender Agreement, hereby terminates the Third Party <br />Lender Agreement and releases Equitable Bank from its obligations under the Third Party <br />Lender Agreement. <br />The foregoing instrument was acknowledged before me this 4th day of May, 2018 by <br />Scott Sailors, President of Nebraska Economic Development Corporation, as Attorney -in -Fact <br />for the United States Small Business Administration. <br />lb <br />
