<br />TRUSTEE'S DEED UPON SALE
<br />D. Charles Shoemaker, Esq., a member of the Nebraska State Bar Association, as trustee (the "Trustee "), does
<br />hereby grant and convey, without any covenant or warranty,
<br />express or implied, to Balcor heal Estate Finance, Inc.,
<br />whose address is 4849 Golf Road, Skokie, IL 60077, its
<br />successors and assigns (the "Grantee "), the following
<br />described property: Lots 2, 3, 4, 5,.11, 12 and 16 of Grand
<br />Island Math, Eighth Subdivision (formerly known as Lots 2, 3,
<br />4 and 5 Grand Island Mall Fifth Subdivision) in the city of
<br />Grand Island, Hall County, Nebraska together with all
<br />hereditaments and appurtenances thereunto belonging (the
<br />"Property "j .
<br />To have and gold the Property unto Grantee, its
<br />successors and assigns, forever.
<br />This conveyance is made pursuant to the powers conferred
<br />on the Trustee blr• that certain deed of trust: dated
<br />September 26, 1984 (the "Deed of Trust "), executed by Grand
<br />Island Mall, Ltd. as truistor to William W. Barney as trustee,.
<br />and Balcor /American Express Real Estate Finance Inc., (now
<br />known as 'Balcor Real Estate Finance Inc.) as beneficiary and
<br />recorded on September 27, 1984 as Document'No'., 84- 005068 in
<br />the Office of Register of needs of Nall..'c©ontY, Nebraska to
<br />secure payment of a promissory note in the original principal
<br />amn "nt of 53,150,000 together with accrued interest as
<br />therein provided.
<br />By a Substitution of Trustee executed, mailed and
<br />recorded as provided in Section 76 -1004 of the Nebraska Trust
<br />Deeds Act, dated February 8, 1989 and recorded. on March 2,
<br />1989 as Document duo. 89- 101024 in the Office of the Register
<br />Of Deeds of Hall County, Nebraska, William W. Barney was
<br />replaced as trustee under the Deed of Trust by the Trustee.
