-- <br />E. <br />f• ' <br />4 <br />O <br />"10499 <br />r W.nREAS, the Partnership: requires 'an easement for ingress <br />and egress over, through and upon Tract I in order, to have access, <br />- .`to Tract II and Goff is willing'-to grant said easement for <br />ingress,and egress do the Partnership; and <br />( WHXREAS, the parties have secured a survey -,to determine the <br />k legal `description of Tract II and to' determine' the legal <br />- ' <br />description on of the` portion of 'Tract I -subject to the grant of <br />easement contained herein, - a copy of which survey is attached <br />hereto as Exhibit "A ",and is-incorporpLted herein. and made a part <br />` hereof by this reference. <br />- � f <br />S <br />L, <br />NOW, THEREFORE, for, good and valuable consideration, the <br />and adequacy of: whichr ls--hereby- `acknowledged; --the parties-.' <br />hereto agree as follows: <br />1: Goff hereby grants, transfers, conveys and assigns to <br />the Partnership (and to the Partnership's agents, representatives, <br />and invitees), as the owner of record of Tract ii,- and to all <br />parties subsequently claiming ownership of Tract II through the <br />Partnership, a permanent easement for ingress and egress to Tract <br />II, over, through and upon a certain portion of Tract I. described <br />as follows,-to-wit: <br />Commencing at the Northwest Corner of Section Wine (9), <br />Township Ten (10) North, Range Eleven (11) West of the <br />6th P.M., Hall County, Nebraska, thence N89 056120 "E on <br />the North line of said Section 9 a distance of 1,599.,89 <br />feet to the point of beginning and the northerly limit <br />of the centerline of a 30 foot easement for ingress and <br />egress; thence S00 027051 11W on said centerline a distance <br />of 1,140.44 feet to a point- and.the Southerly limits of <br />said easement. <br />2. This easement, as granted herein, shall be a perpetual <br />easement, shall run with the land, and shall inure. to and be <br />binding upon. the parties hereto, their heirs, successors and <br />assigns, and all parties claiming ownership of Tract I or Tract <br />II through the parties hereto. <br />Dated this '42900-day of , 1990. <br />William R.
