Oct. 31, 2019. <br />j After Recording Return To: NEDCO, 4445 S. 86th Street, Suite 200, Lincoln, Nebraska 68526 <br />r) <br />TERMINATION AND RELEASE OF THIRD PARTY LENDER AGREEMENT <br />Lot Twenty Two (22), Westgate Subdivision, in the City of Grand Island, Hall County, Nebraska. <br />On 03/19/2013, at the request of Nebraska Economic Development Corporation, Heritage Bank, as the <br />Third Party Lender, executed a Third Party Lender Agreement whereby Heritage Bank made certain <br />representations and commitments with respect to its loan to Trausch Properties, L.L.C. or its <br />affiliates (hereinafter "Borrower "). The Third Party Lender Agreement was subsequently recorded on <br />04/05/2013 as Instrument No. 201302752 in the Records of Hall County, Nebraska, relating to real estate <br />described as: <br />Since Heritage Bank executed the Third Party Lender Agreement, the Borrower has satisfied its <br />obligation to the United States Small Business Administration and Nebraska Economic Development <br />Corporation; which necessitates the termination of the Third Party Lender Agreement and Release of <br />Heritage Bank from its obligations under the Third Party Lender Agreement. <br />Premised upon the foregoing, Nebraska Economic Development Corporation, as Attorney in Fact for the <br />United States Small Business Administration, an agency of the United States of America and assignee of <br />the Third Party Lender Agreement, hereby terminates the Third Party Lender Agreement and releases <br />Heritage Bank from its obligations under the Third Party Lender Agreement. <br />The foregoing instrument was acknowledged before me this 19th day of March, 2018 by Scott <br />Sailors, President of Nebraska Economic Development Corporation, as Attorney -in -Fact for the United <br />States Small Business Administration. <br />
