SEWER AGREEMENT WHEREAS the City of Wood River has in 2017 installed public sanitary sewer abutting and within 100 feet of certain real estate owned by Robert D. Real and Betty Ann Carlson -Real and Gregory S. Real and spouse. WHEREAS the City has constructed public sanitary sewer improvements abutting parts of: WHEREAS the Ordinances of the City of Wood River, set forth: Ordinance No. Section 3-215 requires mandatory hookup to public sewer with in ninety (90) days of official notice and Section 3 -216 requires the cleaning and filling of septic tanks and cesspools following hookup to the public sewer system. WHEREAS the parties are in agreement that hookup may be deferred until such time as Robert D. Real sells or transfers his interest in the above described real estate or dies, whichever event occurs first. NOW THEREFORE, in consideration of the promises of the parties, the parties hereby stipulate that upon the sale, transfer of Robert Real's interest in the property or his death, whichever event occurs first, the owners of the real estate shall connect to the public sewer immediately at their expense and any septic tank, cesspool or other waste water disposal facility located on the property will be cleaned of slug and filled with suitable material by the owners at their expense This agreement shall be recorded with the Hall County Register of Deeds. This agreement and its performance shall be binding upon the successors, personal representatives, heirs, devises, legatees and assigns of the City of Wood River and Robert D.
