<br />ASSIGNMENT OF AGREEMENT FOR THE SALE OF
<br />REAL ESTATE
<br />THIS AGREEMENT, made and entered into this 12th day of September, 2000, by and
<br />between Judith K. Bell, a widow, hereinafter referred to as "Assignor"; Eugene W.
<br />Jeffres, a single person, hereinafter referred to as "Seller" and Wesley T. Tjaden, Jr., a
<br />single person, hereinafter referred to as "Buyer'.
<br />WITNESSETH: For value received, the undersigned Assignor hereby unconditionally
<br />and irrevocably assigns and transfers unto Buyer all right, title and interest in the
<br />following property: A tract of land comprising a part of the West Half of the Northwest
<br />Quarter (W 112 NW 114) of Section Twenty Eight (28) , Township Ten (10) North, Range
<br />Ten (10) West of the 6th P.M., Hall County, Nebraska, and more particularly described
<br />as follows: First, to ascertain the point of beginning, start at the northwest corner of said West Half of
<br />the Northwest Quarter (W 112 NW 114), thence southerly along and upon the west line of said West Half
<br />of the Northwest Quarter (W 112 NW 114), a distance of Six Hundred Eight Five (685.0) feet to the
<br />ACTUAL Point of Beginning, thence deflecting left 90 degrees 00'00" and running easterly, a distance of
<br />One Hundred Seventy Two (172.0) feet; thence deflecting right 90 degrees 00'00" and running southerly,
<br />parallel with the west line of said West Half of the Northwest Quarter (W 1/2 NW 114), a distance of Four
<br />Hundred Thirty Seven and Two Hundredths (437.02) feet; thence deflecting left 94 degrees 38'44" and
<br />running northeasterly, a distance of One Thousand One Hundred Forty Seven and One Tenth (1,147.10)
<br />feet to a point on the east line of said West Half of the Northwest Quarter ((W 112 NW 114), thence
<br />deflecting right 94 degrees 50'04" and running southerly, along and upon the east line of said West Half
<br />of the Northwest Quarter ((W 112 NW 114), a distance of Six Hundred Ninety Three and Eighteen
<br />Hundredths (693.18) feet to a point on the north right of way line of Interstate 80, thence deflecting right
<br />70 degrees 50' 40" and running southwesterly, along and upon said north right of way line, a distance of
<br />Six Hundred Ninety Three and Two Tenths (693.2) feet, thence deflecting right 109 degrees 08' 10" and
<br />running northerly, a distance of Seven Hundred Thirty Seven and Three Tenths (737.3) feet; thence
<br />deflecting left 89 degrees 42' 33" and running westerly, a distance of Six Hundred Fifty Nine and Sixty
<br />Nine Hundredths (659.69) feet to a point on the west line of said West Half of the Northwest Quarter ((W
<br />112 NW 114); thence northerly, along and upon the west line of said West Half of the Northwest Quarter
<br />((W 112 NW 114), a distance of Five Hundred Twenty (520.0) feet to the ACTUAL point of beginning and
<br />containing 14.961 acres, more or less, of which 0.394 acres, more or less, is presently occupied by public
<br />road right of way.
<br />The undersigned hereby warrants that she has full right, power, and authority to enter
<br />into this assignment and transfer, and that the rights and benefits assigned hereunder
<br />are free and clear of any lien, encumbrance, adverse claim or interest except those
<br />being assigned here from an AGREEMENT FOR THE SALE OF REAL ESTATE signed
<br />on or about December 28, 1993 between Assignor and Seller.
<br />Buyer agrees to accept all covenants of the aforementioned original agreement
<br />between Seller and Assignor and to begin making payments of $434.40 on or before
<br />October 15, 2000 for a period of 279 months at 10% interest for said property. As
<br />stipulated in item #2, an additional amount will be added to monthly payment to
<br />accommodate the cost of property taxes. Buyer should also be aware that the deed
<br />remains in the same safety deposit box mentioned in the original contract, but that the
<br />lending institution, formerly known as Overland National Bank, is currently known as
<br />Wells Fargo Bank.
