<br />Agreement of Restrictive Covenant
<br />We, the undersigned owners of real property in Section 23, Township 12 North, Range 10 West
<br />of the 6 Principal Meridian Hall County, Nebraska for the purpose of continuing the properties as
<br />desirable agriculture based land in Hall County, Nebraska; and in consideration of our mutual
<br />interests as parties to that Purchase Agreement executed on 4601-rnht'/ 1 2017 wherein the
<br />following tract of land was sold by Michael J. Isley and Heidi S. Isley, husband and wife, to JZM,
<br />Inc., Zachery S. Mader, its President,
<br />A tract of land in the NW1 /4 of Section 23, Township 12 North, Range 10 West
<br />of the 6 Principal Meridian Hall County, Nebraska, more particularly
<br />described as follows:
<br />Commencing at the Northeast corner of said NW1 /4, thence S 00 °45'33 "E on
<br />the East line of the NW1 /4 and on an assumed bearing (and all bearings
<br />contained herein in area relative, thereto;) a distance of 40.00 feet to the
<br />Southerly right of way of One R Road and the point of beginning; Thence
<br />continuing S00 °45'33 "E on said East line a distance of 1035.58 feet to the North line
<br />38.627 acre tract surveyed by RLS #178 on file at the Hall County GIS office; thence
<br />S89 ° 27'22 "W on said North line of said 38.627 acre tract a distance of 737.33 feet;
<br />Thence N00 02'55"W a distance of 1038.19 feet to the Southerly right of way of One
<br />R Road; thence N89 ° 39'35 "E on said right of way a distance of 724.46 feet to the place
<br />of beginning. Said tract contains 17.39 acres more or less.
<br />Further, as the owners of the adjoining property, that being Lot 1, Isely Acres, Hall County,
<br />Nebraska, Michael J. Isley and Heidi S. Isley, husband and wife, wish to join with JZM, Inc., by
<br />Zachery S. Mader, its President, to covenant and agree with one another that none of us, or our
<br />heirs, executors, administrators, assigns or successors in interest, will ever build, erect, or relocate a
<br />residential or commercial building or buildings, or structure or development of property of any kind
<br />without the prior written consent of the owners of the adjoining property, that being Lot 1, Isely
<br />Acres, Hall County, Nebraska.
<br />Any construction, deed, lease, conveyance, or contract made in violation of this agreement shall
<br />be void and may be set aside on petition of one or more of the parties to this agreement, and all
<br />successors in interest, heirs, executors, administrators, or assigns, shall be deemed parties to this
