SCHIMMER AND SUSAN E. SCHIMMER, <br />husband and wife ( "Owner") and HOOKER BROS. SAND & GRAVEL, INC., <br />( "Hooker "). <br />Owner and Hooker have entered into an Option Agreement by which Owner accords to <br />Hooker the right of lease Owner's property legally described as set forth herein; and <br />The parties wish to give notice of the existence of Hooker's option rights; <br />1. The Legal Description. The legal description of the real property is set forth on the <br />attached Exhibit A (the "Property "). <br />2. Hooker Option Rights. Owner and Hooker have entered into an Option to Lease <br />Agreement effective December 1, 2017, in which Hooker is accorded an option to lease <br />the Property. <br />3. The Option Term. The term of Hooker's option is three (3) years and expires on <br />November 30, 2020 unless extended by written agreement of the parties. <br />4. Notice & Recording. This Memorandum of Option has been executed and <br />delivered by the parties for the purpose of recording and giving notice that a contractual <br />
