1° <br />z <br />rn <br />NOTICE OF FEDERAL INTEREST <br />r, <br />LEGAL NOTICE: THE PROPERTY NAMED IN THIS DOCUMENT WAS ACQUIRED OR IMPROVED USING <br />FEDERAL FUNDING. THEREFORE FEDERAL LAW AFFECTS ITS USE AND /OR DISPOSTITION. BEFORE <br />ATTEMPTING TO PURCHASE, SELL, OCCUPY, TAKE A MORTAGE INTEREST IN OR OTHERWISE <br />ENCUMBER, OR FORECLOSE UPON THIS PROPERTY, YOU MUST NOTIFY THE RESPONSIBLE HHS <br />OFFICIAL LISTED BELOW. <br />Federal law directs the Secretary to establish uniform procedures for Head Start agencies to purchase <br />facilities to be used to carry out Head Start programs. See 42 U.S.C. § 9839(f). Real property acquired or <br />improved with a Federal award is held in trust by the non - Federal entity as trustee for the beneficiaries <br />of the project or program under which the property was acquired or improved. See 45 C.F.R. §75.323, 45 <br />C.F.R. §1303.46 and 45 C.F.R. §1303.47. Facilities acquired with grant funds may not be mortgaged or used <br />as collateral, or sold or otherwise transferred to another party, without the written permission of the <br />responsible HHS official. See 45 C.F.R. § 1303.48(b). <br />On 12 -6 -2017, the Office of Head Start awarded Grant No. 07CH7060 to Head Start Child & Family <br />Development Program Inc. The grant was awarded to provide full day services to Head Start children with <br />funding for an addition to our present owned facility. The grant provided funds that were used for the <br />acquisition or modernization of the facility described below: <br />Warren Fifth Subdivision Block 0 Lot 1 located in Grand Island Hall County, Nebraska or 310 Piper Street, <br />Grand Island, Nebraska. <br />Through this grant award, the Department of Health and Human Services, Administration for Children and <br />Families has acquired a beneficial ownership interest ( "Federal Interest ") in the above named property. <br />This interest applies to the entire facility and land. This NOTICE includes funds awarded in grant awards <br />and any Head Start funds subsequently used to purchase, construct or to make major renovations to the <br />real property. See 45 C.F.R. §1303.47. <br />
