DEED OF TRUST
<br />THIS TRUST DEED made this ��day of 6 , 2000,
<br />between RAYMOND J. O'CONNOR. and JFNNIFER S. O'CO NOR, Husband and
<br />Wife, and MANUEL HERRERA. and CELIA L. FUENTES, Husband and Wife,
<br />all collectively referred to as TRUSTORS, whose address is P.O. Box
<br />139, Grand Island, Nebraska 68802 -0139; WILLIAM A. FRANCIS, A
<br />Member of the Nebraska State Bar Association, as TRUSTEE, whose
<br />address is 222 N. Cedar, Grand Island, Nebraska 68801; and RODNEY
<br />W. CRUMRINE and LISA L. CRUMRINE, Husband and Wife and Joint Owners
<br />as to an undivided one -half (1/2) interest, and CHARLES F. KOHN and
<br />JOYCE KOHN, Husband and Wife and Joint Owners as to an undivided
<br />one -half (1/2) interest, all hereinafter collectively referred to
<br />as BENEFICIARIES, in proportion to their respective ownership
<br />interest.
<br />WITNESSETH:
<br />That TRUSTORS hereby grant, bargain, sell, convey and warrant
<br />to TRUSTEE, IN TRUST, his successors and assigns, with power of
<br />sale, the following - described real property:
<br />Lot Eight (8), Block Ninety -Four (94), Original Town of
<br />Grand Island, Hall County, Nebraska,
<br />together with all buildings, improvements and appurtenances
<br />thereon.
<br />The TRUSTORS hereby covenant and agree with the TRUSTEE and
<br />BENEFICIARIES that RAYMOND J. O'CONNOR, the owner of an undivided
<br />three - fourths (3/4) interest and MANUEL HERRERA, the owner of an
<br />undivided one - fourth (1/4) interest as tenants in common are
<br />lawfully seized and the owner of the above - described property; and
<br />that their spouses execute this Deed of Trust as spouses for
<br />purposes of conveying and pledging their spousal interest in the
<br />above - described property; that they have good right and lawful
<br />authority to sell and convey said premises and that said premises
<br />are free and clear of all. liens and encumbrances (except for the
<br />first mortgage lien of $120,000.00), and further, that TRUSTORS
<br />will warrant and defend the title to said premises forever against
<br />the claims of all persons whomsoever.
<br />For the purpose of securing performance of each agreement of
<br />TRUSTORS herein contained and the payment of THIRTY THOUSAND
<br />DOLLARS ($30,000.00), the TRUSTORS have executed a Promissory Note
<br />bearing even date, at the rate of interest and on the terms and
<br />as 'et cirt_h l.n BUCh Note t] it -.l paid. The principal sum
<br />and interest shall be payable in accorctance with and upon cile terms
<br />and conditions of said Note of even date, and in any event the
<br />entire principal balance due hereunder and any accrued interest
<br />shall be paid on October 1, 2005. All installment payments
<br />hereunder shall be applied first to the payment of interest on the
<br />unpaid balance, pursuant to an Amortization Schedule, a copy of
<br />which has been provided to each of the parties hereto, and
<br />remainder of each payment of earl, >tallment to be applied to
<br />Principal. All payments due shall be paid at the
<br />residence of the BENEFICIARIES or -is tide holder of said security
<br />shall designate in writing.
