WHEN RECORDED MAIL TO: <br />Exchange Bank, PO Box 5793, Grand Island, NE 68802 <br />z <br />nI _° <br />MODIFICATION OF ASSIGNMENT OF RENTS <br />THIS MODIFICATION OF ASSIGNMENT OF RENTS dated ' k ember Z Zo 7 , is made and executed <br />between EPGI, L.L.C., a Nebraska Limited Liability Company (referred to below as "Grantor") and <br />Exchange Bank whose address is PO Box 5793, Grand Island, NE 68802 (referred to below as "Lender"). <br />ASSIGNMENT OF RENTS. Lender and Grantor have entered into a ASSIGNMENT OF RENTS dated March <br />1, 2017 (the "ASSIGNMENT OF RENTS ") which has been recorded in Hall County, State of Nebraska, as <br />follows: <br />Filed on March 1, 2017 as Instrument No. 201701339. <br />REAL PROPERTY DESCRIPTION. The ASSIGNMENT OF RENTS covers the following described real <br />property located in Hall County, State of Nebraska: <br />Lot One (1), Block Eight (8), Replat, Continental Gardens, an Addition to the City of Grand Island, <br />Hall County, Nebraska, EXCEPTING therefrom that portion Deeded to the City of Grand Island in <br />Warranty Deed recorded as Document No. 201404306 <br />The Real Property or its address is commonly known as 3033 West Capital Ave. <br />MODIFICATION. Lender and Grantor hereby modify the ASSIGNMENT OF RENTS as follows: <br />Grantor will be changed from EPGI, L.L.C., a Nebraska Limited Liability Company to Edwards <br />Building Corp., a Nebraska Corporation pursuant to Special Warranty Deed, dated September 12, 2017, <br />from EPGI, L.L.C., A Nebraska Limited Liability Company (GRANTOR) to Edwards Building Corp., a <br />Nebraska Corporation (GRANTEE). <br />CONTINUING VALIDITY. Except as expressly modified above, the terms of the original ASSIGNMENT OF RENTS shall remain <br />unchanged and in full force and effect and are legally valid, binding, and enforceable in accordance with their respective terms. <br />Consent by Lender to this Modification does not waive Lender's right to require strict performance of the ASSIGNMENT OF <br />RENTS as changed above nor obligate Lender to make any future modifications. Nothing in this Modification shall constitute a <br />satisfaction of the promissory me or other credit agreement secured by the ASSIGNMENT OF RENTS (the "Note "). It is the <br />intention of Lender to retain as liable all parties to the ASSIGNMENT OF RENTS and all parties, makers and endorsers to the <br />Note, including accommodation parties, unless a party is expressly released by lender in writing. Any make or endorser, <br />including accommodation makers, shall not be released by virtue of this Modification. If any person who signed the original <br />ASSIGNMENT OF RENTS does not sign this Modification, then all persons signing below acknowledge that this Modification is <br />given conditionally, based on the representation to Lender that the non - signing person consents to the changes and provisions <br />of this Modification or otherwise will not be released by it. This waiver applies not only to any initial extension or modification, <br />but also to all such subsequent actions. <br />GRANTOR ACKNOWLEDGES HAVING READ ALL THE PROVISIONS OF THIS MODIFICATION OF <br />ASSIGNMENT OF RENTS AND GRANTOR AGREES TO ITS TERMS.
