201707665 <br />b. "Owner" shall mean an owner of one or more of Lots Five (5) through <br />Seventeen (17), Summerfield Estates Tenth Subdivision in the City of <br />Grand Island, Hall County, Nebraska. <br />c. "Properties" shall mean and refer to Lots Five (5) through Seventeen (17), <br />Summerfield Estates Tenth Subdivision in the City of Grand Island, Hall <br />County, Nebraska. <br />d. "Lot" shall mean and refer to any platted Lot of land upon the recorded <br />subdivision plat of the Properties and shall include only Lots Five (5) <br />through Seventeen (17), Summerfield Estates Tenth Subdivision in the <br />City of Grand Island, Hall County, Nebraska, such plat being recorded in <br />the Office of the Register of Deeds of Hall County, Nebraska. <br />e. "Covenants" shall mean this DECLARATION OF RESTRICTIVE <br />COVENANTS, RESTRICTIONS AND CONDITIONS FOR <br />SUMMERFIELD ESTATES TENTH SUBDIVISION <br />2. The following covenants shall apply to each Lot: <br />a. All Lots in the subdivision shall be known and described as residential <br />Lots. <br />b. All construction and building shall be so performed that it will comply <br />with the requirements of the building codes and ordinances of the City of <br />Grand Island, Nebraska. <br />c. No building or dwelling house shall be moved into said subdivision and <br />placed upon a Lot. No pre -fab, modular or mobile home shall be placed <br />on a Lot; no trailer, tent, garage, shack or any other unsightly out - building <br />shall be used in said subdivision as a dwelling at any time, nor shall any <br />structure of a temporary nature be used as a residence. <br />d. No barns, chicken houses, horse trailers, commercial work or sales shops, <br />or other buildings for the care and housing of fowl, rabbits or livestock <br />shall be placed, maintained or used on any Lot; nor shall any fowl, rabbits, <br />livestock or animals other than household pets be kept upon any Lot, and <br />household pets shall not be kept, bred or maintained for any commercial <br />purposes. No noxious or offensive activity shall be permitted on any Lot <br />nor shall there be anything done thereon which may become an annoyance <br />or nuisance to the neighborhood. <br />e. No individual dwelling consisting of one level shall be constructed with <br />less than 1,750 square feet of living area, not including the garage. No <br />dwelling consisting of a two story design shall have less than 1,250 square <br />feet of living area on the ground floor, not including the garage. <br />Townhomes and condominiums are not permitted. <br />f. No structure shall be erected, altered, place or permitted to remain on any <br />Lot other than one (1) single family dwelling with attached private garage <br />for three (3) vehicles and any detached garage or other out - buildings <br />incidental to the residential use of the Lot. No dwelling shall be erected or <br />used for occupancy by more than one family. No structure, fence or other <br />obstruction shall be erected, altered, placed or permitted to remain in any <br />drainage easement. <br />g. <br />No commercial or business enterprises shall be conducted or operated in <br />said subdivision. No Lot or Lots shall be divided or split to create smaller <br />lots or building areas. Lots may be combined, or divided, to establish <br />larger Lots. <br />
