Grand Island, Nebraska <br />This Document was Prepared by and, <br />After Recording, Should Be Returned to: <br />Fleet Business Credit Corporation <br />One South Wacker Drive 200107257 <br />Chicago, Illinois 60606 <br />Attention: Franchise Finance Division <br />Susan Thompson <br />ASSIGNMENT OF RIGHTS IN LEASE <br />THIS ASSIGNMENT OF RIGHTS IN LEASE (this "Assignment ") is made as of <br />the 18'h day of July, 2001, by CONCORD NEIGHBORHOOD CORPORATION, a Kansas <br />corporation ( "Assignor "), to FLEET BUSINESS CREDIT CORPORATION, a Delaware <br />corporation ( "Lender "). <br />WITNESSETH: <br />WHEREAS, Lender has agreed to make certain loans, advances and /or other <br />financial accommodations to Assignor and Concord Hospitality, Inc., an affiliate of Assignor <br />( "Hospitality"); and <br />WHEREAS, to evidence its indebtedness to Lender and to provide security for <br />the repayment of said loans, advances and other financial accommodations from Lender which <br />now and hereafter may be made, Assignor and Hospitality have executed and delivered to <br />Lender one or more promissory notes (collectively, the "Note "), and a Loan and Security <br />Agreement (the "Loan Agreement ") and certain other Loan Documents; and <br />WHEREAS, Assignor has entered into a lease agreement dated August 1, 1999, <br />with Hospitality (hereinafter referred to as "Lessor ") for occupancy of the property situated in <br />the City of Grand Island, County of Hall and State of Nebraska and commonly described as <br />721 Diers Avenue, Grand Island, Nebraska 68803 (the "Property "), which Property is legally <br />described on Exhibit "A" attached hereto (which lease, together with all of Assignor's rights <br />and remedies thereunder, are hereinafter referred to as the "Lease "); and <br />WHEREAS, as a condition of Lender's making the loans, advances and other <br />financial accommodations referred to herein and as security for the payment of all obligations <br />and other liabilities of Assignor under the Note, the Loan Agreement and the other Loan <br />Documents and for the payment or other satisfaction of all other indebtedness or other <br />liabilities and obligations of Assignor to Lender, whether under the Note, the Loan Agreement <br />or the other Loan Documents (collectively, the "Obligations "), Lender is requiring this <br />Assignment. <br />003.300667.1 <br />
