y. <br />ILL <br />l� <br />vz� _ _ <br />89- 102.63 <br />LICENSE AGREEMENT <br />This License Agreement is made by and between the CITY OF <br />GRAND ISLAND, NEBRASKA, a Municipal Corporation, herein referred <br />to as the "City" and BUSINESS WORLD PRODUCTS, INC., a <br />corporation, hereinafter referred to as the "Licensee ". <br />1. STATEMENT OF PURPOSE. The purpose of this License <br />Agreement is to set forth the teems and conditions under which <br />the Licensee may construct, maintain, repair, and utilize the <br />following described improvements which will infringe upon real <br />estate owned or controlled by the City: <br />A truck ramp crossing the public utilities easement <br />located on the following described real estate and <br />situated as shown on Exhibit A, which is attached <br />hereto and made a part hereof by reference. <br />Four awnings which will encroach upon the north side <br />of West Third Street to be situatdd approximately as <br />shown on Exhibit B, attached hereto and made a part <br />hereof by reference. Said awnings shall provide a <br />minimum of eight (8) feet of clearance above the <br />sidewalk and shall extend no closer than three (3) <br />feet from the curb line. <br />Three trees to be located in the south half of the <br />sidewalk along the north side of West Third Street <br />adjacent to the following described real estate and <br />situated approximately as shown on Exhibit C, attached <br />hereto and made a part hereof by reference. The <br />sidewalk openings for the trees shall measure no more <br />than four (4) feet per side and shall be covered either <br />with metal gratings or the opening occupied with such <br />vegetation as will prevent pedestrians from stepping <br />into the sidewalk openings. The sidewalk openings <br />shall be kept clean and free of debris, weeds and` <br />leaves. The easternmost tree shall be no less than <br />thirty (30) feet from the signal light pole locatedvat <br />the northwest corner of the intersection of Eddy Street <br />and West Third Street as measures from the easternmost_ <br />drip line of said tree. <br />Four trees to be located in the west half of the <br />sidewalk along the east side of Clark Street adjacent <br />to the following described real estate and situated <br />approximately as shown on Exhibit D, attached hereto <br />and made a part hereof by reference. The sidewalk <br />opening-- for the trees shall measure no more than four <br />(4) feel per side and shall be covered either with <br />metal gratings or the openings occupied with such <br />visitation as will prevent pedestrians from stepping <br />into the sidewalk openings.
