<br />KNOW ALL MEN BY THESE PRESENTS:
<br />TRUSTEE'S DEED
<br />That a Deed of Trust was made and entered into on or about March 26, 2015, by and between
<br />Randall Kowalski, as Trustor, and Pathway Bank, Beneficiary, wherein Pathway Bank was
<br />named Trustee. This Deed of Trust was recorded March 30, 2015, instrument number
<br />201501887, Hall County, Nebraska.
<br />Marvin L. Andersen, Member of the Nebraska State Bar Association, has been appointed
<br />successor Trustee, pursuant to a Substitution of Trustee filed for record in instrument number
<br />201607402, Hall County, Nebraska. Hereinafter the Successor Trustee, Marvin L. Andersen,
<br />Attorney at Law, will be referred to as GRANTOR.
<br />The GRANTOR in consideration of Six Hundred Thirteen Thousand Nine Hundred Twenty Five
<br />dollars ($613,925.00) and other valuable consideration received from Pathway Bank, hereinafter
<br />GRANTEE, does hereby grant, bargain, sell, convey and confirm unto GRANTEE the following
<br />described real property in Hall County, Nebraska:
<br />A tract of land comprising a part of the Northeast Quarter (NE1 /4) of Section Eleven (11),
<br />Township Eleven (11) North, Range Nine (9), West of the 6 P.M., North of the Union
<br />Pacific Railroad track, Hall County, Nebraska, EXCEPT for a tract commencing at the
<br />Northwest corner of the Northeast Quarter of Section Eleven (11), thence running East
<br />Two Hundred Sixty (260) feet; thence South Five Hundred and Eighteen (518) feet, thence
<br />West Two Hundred Sixty (260) feet; thence North Five Hundred Eighteen (518) feet to the
<br />POINT OF BEGINNING and EXCEPT a tract commencing at the Northeast corner of the
<br />Section Eleven (11), Township Eleven (11) North, range Nine (9), thence Westerly One
<br />Thousand Six Hundred Thirteen and Twenty Six Hundredths (1,613.26) Feet; thence
<br />Southerly One Thousand Eight Hundred Fourteen and Seventeen Hundredths (1,814.17)
<br />Feet to the North right of way line of the Union Pacific Railroad; thence Northeasterly One
<br />thousand Seven Hundred Ninety Five and Fifty Nine hundredth (1,795.59) Feet; thence
<br />Northerly to the POINT OF BEGINNING, EXCEPT public road Right of Way.
<br />To have and to hold the above - described premises together with all tenements, hereditatments
<br />and appurtenances thereto belonging unto the GRANTEE, and to the GRANTEE'S successors
<br />and assigns forever.
<br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors
<br />and assigns:
<br />1. That Randall Kowalski, failed to pay the Beneficiary payments which were contractually due,
<br />and the GRANTOR, at the request of the Beneficiary, elected to declare the entire unpaid
<br />principal balance, together with interest thereon, at once immediately due and payable.
<br />2. That a Notice of Default was recorded by GRANTOR on April 21, 2017 in instrument number
<br />201702549, Hall County, Nebraska. Within ten days thereafter, a copy of the recorded Notice of
<br />Default was mailed to all parties entitled to notice, pursuant to said Deed of Trust and in
<br />compliance with Neb. Rev. Stat. Section 76 -1008.
<br />3. That Trustor, Randall Kowalski, failed to cure the default referenced in the Notice of Default
<br />within 30 days after the recording of the Notice of Default.
