Declaration, but such limitation shall not affect, in any manner, any other rights or remedies which any Party may have hereunder by reason of any breach of the provisions of this Declaration. Section 7.5 Limitation of Liability. Notwithstanding the foregoing, any person acquiring fee or leasehold title to a Parcel, or any portion thereof, shall be bound by this Declaration only as to the Parcel or portion of the Parcel acquired or possessed by such person. In addition, such person shall be bound by this Declaration only during the period such person is the fee or leasehold owner or occupant of such Parcel or portion of the Parcel; and, upon conveyance or transfer of the fee or leasehold interest shall be released from liability hereunder, except as to the obligations, liabilities or responsibilities that accrue prior to such conveyance or transfer. Although persons may be released under this Section, the easements, covenants and restrictions in this Declaration shall continue to be benefits to and servitudes upon said Parcels running with the land. Section 7.6 Breach. In the event of breach or threatened breach of this Declaration, only the Parties shall be entitled to institute proceedings for full and adequate relief from the consequences of said breach or threatened breach. In the event of a breach hereof, the non - prevailing Party shall pay the reasonable attorneys' fees of the prevailing Party. ARTICLE VIII COMMON AREAS AND OPERATING COSTS Section 8.1 Declarant's Control. All Common Areas and Common Utility Areas in or about the Mall shall be subject to Declarant's exclusive control and management. Declarants shall operate, manage, equip, police, light, surface, maintain, repair and replace (or cause all of the same to occur to) the Common Areas and Common Utility Areas in good and reasonable condition and manner and Declarants shall have the sole right and exclusive authority to employ and discharge all personnel with respect thereto and/or hire independent contractors to perform the same. In addition, Declarant may provide (or cause to be provided) security in the Common Areas at a level determined by Declarant. All costs and expenses incurred under this Section by Declarant shall be included in the definition of "Operating Costs" (as defined in Section 8.7). 25 201706687
