Declaration, but such limitation shall not affect, in any manner, any other rights or remedies <br />which any Party may have hereunder by reason of any breach of the provisions of this <br />Declaration. <br />Section 7.5 Limitation of Liability. Notwithstanding the foregoing, any person acquiring <br />fee or leasehold title to a Parcel, or any portion thereof, shall be bound by this Declaration only as <br />to the Parcel or portion of the Parcel acquired or possessed by such person. In addition, such person <br />shall be bound by this Declaration only during the period such person is the fee or leasehold owner <br />or occupant of such Parcel or portion of the Parcel; and, upon conveyance or transfer of the fee or <br />leasehold interest shall be released from liability hereunder, except as to the obligations, liabilities or <br />responsibilities that accrue prior to such conveyance or transfer. Although persons may be released <br />under this Section, the easements, covenants and restrictions in this Declaration shall continue to be <br />benefits to and servitudes upon said Parcels running with the land. <br />Section 7.6 Breach. In the event of breach or threatened breach of this Declaration, only the <br />Parties shall be entitled to institute proceedings for full and adequate relief from the consequences <br />of said breach or threatened breach. In the event of a breach hereof, the non - prevailing Party shall <br />pay the reasonable attorneys' fees of the prevailing Party. <br />ARTICLE VIII <br />COMMON AREAS AND OPERATING COSTS <br />Section 8.1 Declarant's Control. All Common Areas and Common Utility Areas in or <br />about the Mall shall be subject to Declarant's exclusive control and management. Declarants <br />shall operate, manage, equip, police, light, surface, maintain, repair and replace (or cause all of <br />the same to occur to) the Common Areas and Common Utility Areas in good and reasonable <br />condition and manner and Declarants shall have the sole right and exclusive authority to <br />employ and discharge all personnel with respect thereto and/or hire independent contractors to <br />perform the same. In addition, Declarant may provide (or cause to be provided) security in the <br />Common Areas at a level determined by Declarant. All costs and expenses incurred under this <br />Section by Declarant shall be included in the definition of "Operating Costs" (as defined in <br />Section 8.7). <br />25 <br />201706687 <br />
