6. No application or petition for the appointment of a Personal Representative is pending or has <br />been granted in any jurisdiction. <br />7. Affiants have made an investigation and have been unable to locate a Last Will and <br />Testament for the Decedent. Frank Meyer is entitled to the Decedent's interest in the real estate described <br />above by virtue of being the surviving spouse of the Decedent, and in 1997 the surviving spouse's share of <br />the intestate estate was the first $50,000.00 plus one -half of the balance. <br />8. Affiants swear and affirm that all statements in this affidavit are true and material, and <br />further acknowledge that any false statement may subject Affiants to penalties relating to perjury under <br />Nebraska Statute, Section 28 -915. <br />9. Pursuant to Nebraska Probate Code Section 30- 24,130 (2016 Supplement), any purchaser <br />from, or lender to Affiants, shall have the same protection as a person purchasing from or lending to a <br />distributee who has received a deed of distribution from a personal representative as provided in Nebraska <br />Probate Code, Section 30- 24,106 (2016 Supplement). <br />10.
