Stoppkotte, being first duly sworn on oath, deposes and states as follows: 1. I am the spouse of Kelly K. Stoppkotte (the "Decedent ") who died on February 7, 2017, and I have an interest in the real estate described in Exhibit A. I am the beneficiary of the Kelly K. Stoppkotte Marital Bequest by way of beneficial interests created in trust. 2. On January 29, 2017, Kelly K. Stoppkotte executed her Last Will and Testament. The Will provides that upon her death, all debts, expenses, and taxes shall be paid and the residue is to be devised and bequeathed unto the Trustee of the Kelly K. Stoppkotte Revocable Trust. I am the duly appointed, qualified, and acting Trustee of the Estate of Kelly K. Stoppkotte. 3. On January 29, 2017, the Kelly K. Stoppkotte Revocable Trust was created by agreement with the intent to distribute her assets to me, her spouse, outright by way of a Martial Bequest. I am the duly appointed, qualified, and acting Trustee of the Kelly K. Stoppkotte Revocable Trust. 4. A photocopy of the death certificate for Kelly K. Stoppkotte is attached to this Affidavit as Exhibit B. 5. Thus, all assets will distribute outright to me after they pass through the trust. 6. Pursuant to Nebraska Revised Statue 77 -2004, no inheritance tax return is required to be filed in the Estate of Kelly K. Stoppkotte since (i) there is no federal estate tax filing obligation, and (ii) all of the decedent's assets either were held in joint tenancy with right of survivorship solely between the decedent and myself, or passed by beneficiary designation or pursuant to a trust intended to pass the decedent's property at death. 7.
