F <br />IF `q. <br />89-- 101533 <br />AGREEMENT FOR PROTECTIVE COVENANTS, RESTRI, <br />AND CONDITIONS FOR ROUSH SUBDIVISION <br />WHEREAS, the undersigned, Roadrunner Development, Inc., a <br />Nebraska Corporation (hereinafter referred to as "Roadrunner ") is <br />the owner of Lots. 9 through 16 of Block 1, Lots 12 through 18 of <br />Block 2, Lots 1 through 8 of Block 5 and Lots 1 through 8 of <br />Block 6; and Whereas, Randall Dee Rockwell and Donna Lee <br />Rockwell, husband and wife, are the owners of Lots 7, 8 and 9 in <br />Block 2; Bernard E. Swanson and Esthermae Swanson, husband and <br />wife,, are the owners of Lot 6 in Block 2; Donald L. Madison and <br />Marie D. Madison; tWsnand and r.,rife, are the owners of Lots 4 and <br />5—in—Block 2 and Scdt.t H. Bi-s end and Terri S. Bilslend, husband <br />and wiLi�, are the owners of Lot 3 in' Block 2 (hereinafter , <br />referred to as "Home ;Cwners ") , all such lots being-In Roush <br />Subdivision, a resubdivision of the North 543' of Lots L through <br />15, inclusive, of Matthew -'s Subdivision, a part of the'116k thwest <br />Quarter of Section 27, Township 11 North, Range 9 West of the 6th <br />P.M., as shown on the plat heretofore filed in the offices of the <br />Register of Deeds in Hall County, Nebraska; and <br />WHEREAS, Roadrunner has , requested the Grand' lsland: C.i ty <br />Council to change the zoning in the Roush subdivis.i a''n.: fiq'n R2 tip. <br />R2 -MD to allow double- v-46_- manufactured 'homes to bd :la,crat+ed on <br />the platted lots; and <br />WHEREAS, the protective. covenants as originaLLy filed in <br />Book 8, Page 475 of Miscellaneous Records have been rescinded; <br />and <br />WHEREAS, Home Owners object to placing of double -wide <br />manufactured :homes in the Subdivision because it would cause a <br />deprecation in the :value of their conventionally built homes. <br />NOW, THEREFORE, in consideration of Home Owners agreeing not <br />to protest the change in zoing from R2 to R2 -MD allowing the <br />placement of premanufactured double wide homes in Lots 9 through <br />16 in Block 1, Lots I through 8 in Block 5, and Lots 1 through. 8 <br />in Block 6, all in Roush Subdivision, Roadrunner agrees to the <br />following conditions and covenants: <br />1.- Roadrunner agrees that it i•111 not now or in the future <br />request. "a change in zoning from.-:7!2 to R2 -MD, nor ;rill it ever <br />permit double -wide manufactured homes to be located on Lots 12 <br />through 18 it S ock 2 of the Roush Subdivision. <br />2. Roadrunner further agrees not to change the size of Lots <br />12 through 18 in Block 2 from their present size of 1001 x 150'. <br />3.
