In any judicial aroceediiig to which the <br />County is a party and which, in.the opinion; of tlie,Trustee and <br />.its co.unsel, has a substantial -bearing on the interest of owners <br />of the bonds issued hereunder- the Trustee may ;intervene on :behalf <br />of the owners of the bonds and shall do so if .requested in wri ing <br />by the -owners of at least ten percent (10%) of the,vaggregat&princi- <br />pal amount of bonds outstanding hereunder. !The rights and obliga- <br />tions of the Trustee under this section are subjectto the approval <br />of a court of competent jurisdiction in theipremises. <br />Section 1005. Any corporation or association'into which -the' <br />Trustee may be .converted or merged, or with' ,which 'it may be`'con- <br />solidated, or to which it may sell or transfer its trust business; <br />and assets, as�a whole or substantially as a whole', or.any corpora-. <br />tion or association resulting from any such!,`conversion,: sale -- <br />merger, consolidation <br />ale-- <br />merger,:consoli:dation or transfer to which it is a!party; ipso <br />facto, shall be and become -successor -trustee hereunder and vested <br />with all of the title to 'the whole property'i ;or ;trust estate ;and <br />all the trusts, powers, discretions, immunities.,.privileges':and <br />all other matters as was its predecessor, without the execution <br />or filing of any instrument or any further act, deed or conveyance <br />on the part oflany of the parties hereto, anything!herein to'the <br />contrary notwithstanding. <br />Section 1006. The Trustee may at any time resign from; the <br />trusts hereby created by giving thirty (30)1, days .written notice <br />by registered or certified mail to the Coun;ty,,to the Lessee and <br />to the owners of bonds outstanding hereunder at their respective <br />registered or last -known addresses, and such resignation shall <br />take effect at -the end of such thirty (30) ;days, or upon the earlier <br />appointment of'a successor -trustee by the owners of the bonds: oz <br />by the County <br />Section 1007. The Trustee.may be removed at ;any time .by an <br />instrument or'concurrent instruments in writing delivered to the <br />Trustee, to the County and to the Lessee, and signed by the owners <br />of a majority2in aggregate principal-amoun't of bonds outstanding <br />hereunder.. <br />X-4 <br />
