iistee's part to term nate' the Lease and Agreement with' the <br />Lessee, unless the termination thereof be decreed by a court of <br />competent jurisdiction, and no such repossession by.the Trustee <br />shall:.relieve the Lessee .of..its`obligation;to-pay basic rent-. and-... <br />additional rent; or of any of -its other obligations under said <br />Lease and Agreement, all of which.shall survive such repossession- <br />or <br />epossessionor other action hereunder and shall not impair Trustee's right to <br />require the Lessee to pay .the basic rent and all additional rent =� <br />provided for in said Lease and Agreement until the end of the term <br />and whether or not the Project shall have been relet, less the net <br />proceeds.,.if any, of any reletting of the Project,'after deduction-. <br />of all of•the Trustee's expenses in or in connection with such <br />reletting, including without limitation, all repossession costs, <br />brokerage commissions, legal expenses, attorneys' fees, expenses <br />of employees, alteration costs and expenses of preparation for <br />reletting. Having elected to reenter or take possession of the <br />Project without terminating said Lease and Agreement or the term <br />therein provided for,`..the Trustee,may by notice to the Lessee given <br />at anytime thereafter while Lessee is in default in the payment <br />of basic rent or additional rent, or in the performance of any other <br />obligation under said Lease and Agreement,..elect to terminate said. <br />Lease and Agreement and the term then in effect as provided in said <br />Lease and Agreement. <br />Section 915. Anything -herein to the contrary notwithstanding,. <br />the Trustee may furnish to the Lessee or to any other person requesting <br />the same a certificate or certificates to the effect that there <br />are'to. the knowledge. of the Trustee -no defaults hereunder or under <br />the Lease'and Agreement if, in fact, there.:are not then in 'exis- <br />tence, to the knowledge of the Trustee, any defaults which 'consti- <br />tute. an "event of default" as herein defined, or which are,, in the <br />opinion of the Trustee, of such a serious nature as to be materially <br />detrimental to the best interests of the owners of the bonds or to <br />.the security -provided by this Mortgage, it being the intent of the <br />County and of the Trustee to hereby facilitate, insofar as may be ' <br />possible, but without in any way limiting the generality of the <br />foregoing, the giving of'. such assurances as may be necessary -in order <br />IX -10 <br />
