009191 <br />Section 509; Reference is hereby made to (1) Article IV, <br />of the -Lease and;Agreement with reference to -payments to be made - <br />by the Trustee out of the' Acquisition Fund, -(2) Section .7.'6 of <br />the Lease and Agreement:.with' reference _to sale=, substitution , and. `. <br />release.of Leased Equipment, and (3) Sections 13.2 and 14.4 of <br />the Lease' and Agreement, whereunder, it is provided 'that under.. <br />certain circumstances insurance and coridemnation'proceeds.are <br />to be paid to the Trustee and deposited in aitrust account to.�be <br />designated the "Replacement Account", and tobe di bursed.and, <br />paid out as therein provided,.as well as too'ther provisions:'of <br />-the Lease and Agreement under which the Trustee may be called, <br />upon to act. The Trustee hereby accepts and !agrees to perform . <br />the duties and obligations as therein specified. <br />Section 510. The, Trus tee -agrees to be bound `by and comply <br />with any directions contained in the Lease and Agreement with <br />respect to the application of money paid into -the Bond Fund. The <br />Trustee agrees to notify the County in writing of any failure -by <br />Lessee in making any of the payments required to be made by <br />Lessee to the Trustee and of noncompliance with 'any: of the other <br />covenants of Lessee contained in the Lease and Agreement of <br />which the Trustee has knowledge.. <br />Section 511. Any amounts remaining in the 'Bond Fund (in <br />cluding the Reserve Account), or in any other fund or account <br />established hereunder;"after payment in full' :of -the bonds, thee. <br />fees, charges and expenses of the Trustee and all other amounts <br />requiredto be paid hereunder shall be paid to the Lessee upon <br />the expiration or sooner:termination of the ';term of the Lease.' <br />and Agreement. <br />
