The lien of this Mortgage is subject and:sub- <br />ordinate to the Lease and Agreement and neither a foreclosure of <br />the lien of this Mortgage nor the appointment of a receive ! r for <br />the trust estate nor any other procedure related to the enforce- <br />ment of'the, lien orthe provisions of this Mortgage shall of itself <br />terminate or otherwise affect or impair the rights, privileges or ob- <br />ligations of the Lessee under the Lease and Agreement in accordance <br />with its terms.- The I Lease and Agreement, sets forth the covenants and <br />obligations of -the County and the Lessee, including a provision that: <br />the said Lease and Agreement maynot be effectively amended., changed, <br />or modified without the.concurring written consent of theIrustee, <br />and (in certain cases) s) without the concurring written consent of <br />the owners of -a majority -in aggregate gregate principal amount ofthe bonds <br />then outstanding, all a-s:'provided in Article XII of this Mortgage, <br />and reference is hereby made to the same fora detailed statement <br />of the -said covenants and obligations of -the Lessee underthe Lease <br />and Agreement, and the County agrees'that-.the Trustee in its. name <br />or in 'the name of the County may enforce all rights of the Lessor <br />and all obligations of the Lessee under and pursuant to the said <br />Lease and Agreement, for and on behalf of the owners of the bonds, <br />whether or not the Lessor (County) is in default in its covenants <br />to enforce such rights* and obligations. <br />IV -5 <br />
