possession of the premises and every part thereof and Mortgagor <br />shall promptly and peaceably deliver said full•.and-complete <br />possession to Mortgagee, and Mortgagee shall be.accountable only <br />to the extent of such moneys or income as are actually collected <br />and applied. Mortgagor further covenants and agrees that Mort- <br />gagee may give notice of default and of its exercise of the <br />above-granted powers and rights by letter addressed to Mortgagor, <br />its successors and assigns, at their last address known to Mort- <br />gagee. Mortgagor further covenants and agrees that the. exercise <br />-of the above right, authority and power shall in no manner be <br />dependent upon, affect,.impair or restrict.the right of Mortgagee <br />to foreclose this mortgage in case of default and shall not in <br />any manner whatsoever delay or postpone such foreclosure if <br />Mortgagee elects to commence such foreclosure proceedings.: <br />Mortgagor agrees to furnish to Mortgagee, after Mortgagee's <br />request therefor, Mortgagee's duly executed and acknowledged`. <br />assignment in recordable form, and otherwise in form and substance <br />satisfactory to Mortgagee, of such leases of the premises as. <br />Mortgagee may request and an executed attornment agreement from <br />such lessees as Mortgagee may request, in form and substance <br />satisfactory to Mortgagee, whereby such lessees agree that•they <br />will attorn to Mortgagee if it becomes a.mortgagee in possession <br />or a purchaser at the foreclosure sale of the premises and to any <br />other purchaser at such foreclosure sale. <br />22. In the event all or any part of the premises is <br />sold, transferred, conveyed or encumbered.to any person, corporation <br />or entity without the written consent of Mortgagee, or in the <br />event Mortgagor makes an assignment for the benefit of creditors, <br />a receiver is appointed for Mortgagor or for all or any part of <br />the premises, Mortgagor files a petition or institutes proceedings <br />in bankruptcy or,is.adjudicated a bankrupt under any state laws <br />for. the relief of debtors or under the bankruptcy laws of the <br />United States, or in the event title to all or any part of the <br />premises shall become vested in any person, corporation or. entity <br />other than the Mortgagor in any other manner whatsoever, then, or <br />at any time thereafter,.the whole of the aforesaid indebtedness <br />and all other sums secured by this mortgage shall become due and <br />payable at once at the option of the Mortgagee. The acceptance <br />of one or more payments on the indebtedness or other sums secured <br />by this mortgage made by anyone-other than the Mortgagor shall <br />not. constitute the Mortgagee's consent toorapproval of any' <br />sale,-transfer or'conveyance of all or any part of the premises <br />nor shall such acceptance constitute Mortgagee's waiver of its. <br />right to accelerate the.maturity of the aforesaid indebtedness <br />and all other sums secured hereby. <br />23. The covenants, conditions and terms herein con <br />tained shall bind, and the benefits and advantages shall inure <br />to, the respective successors and assigns of the parties hereto. <br />Whenever used herein the singular number shall include the plural,, <br />the plural shall include the singular, the use of any gender <br />shall be applicable to all genders, and the term "Mortgagee <br />shall include any payee'-of the aforesaid promissory note hereby <br />secured or any holder, transferee or endorsee thereof, whether by <br />operation of law or otherwise. <br />24. This mortgage shall be'construed and enforced ac- <br />cording to the laws of the State of Nebraska. <br />25. If default be made in the payment of the aforesaid <br />.promissory note or any part thereof or of any installment due in <br />accordance with the terms hereof, either•on principal, interest <br />or in the performance of any of the covenants, terms or condi- <br />8' <br />
