Should Beneficiary elect to foreclose by exercise of the Power of Sale herein contained, Beneficiary shall notify Trustee and shall deposit "with Trustee this Deed of Trust, and such receipts and evidence of expendi- tures made secured hereby as Trustee may rcquire. Upon receipt of such notice from Beneficiary, Trustee shall cause to be recorded, published and delivered to Trustor such Notice of Default and Notice of-Sale as then required by law and by this Deed of Trust. The recitals in such deed of any matters or facts shall be prima facie proof of the truthfulness thereof to the extent provided by Nebraska law. Any person, including, without limitation, Trustor, Trustee or Beneficiary, may purchase at such sale and Trustor hereby cove- nants to warrant and defend the record title of such purchaser or purchasers exclusive of any acts or omissions of Trustee. As may be permitted by law, after deducting all costs, fees arid. expenses of Trustee ' of this Trust, including costs of evi- dence of title in connection with sale, Trustee shall apply the proceeds of sale to payment of (i) all sums expended under the terms hereof, not then repaid, with aacrue'd interest at the rate applicable to outstanding Advances (under 'aiid as defined in the Loan Agreement) until repaid by Trustor, (ii) all other sums then secured hereby, and (iii) the remainder, if any, to the person or persons legally entitled thereto.
