ORDINANCE NO. 8612 (Cont.) <br />Heights Fourth Subdivision; thence north on a line Eight (8.0) feet west of and <br />parallel to the east line of said Lot Eight (8.0) also being the west line of an Eight <br />(8.0) foot utility easement, to a point Eight (8.0) feet west of the northeast corner <br />of said Lot Eight (8); thence east along the north line of Lot Eight (8) Western <br />Heights Fourth Subdivision and Lot Seven (7) Double R Subdivision to a point <br />Eight (8.0) feet east of the northwest corner of Lot Seven (7) Double R <br />Subdivision; thence south on a line Eight (8.0) feet east of the west line of said <br />Lot Seven (7), also being the east line of an Eight (8.0) foot utility easement to a <br />point Eight (8.0) feet' east of the southeast corner of said Lot Seven (7); thence <br />west along the south line of said Lot Seven (7) to the southeast corner of Lot <br />Eight (8) Western Heights Fourth Subdivision; thence south along the east line of <br />Western Heights Fourth Subdivision and the west line of Western Heights Fifth <br />Subdivision to a point Thirty Three (33.0) feet north of the centerline of 13th <br />Street; thence west on a line Thirty Three (33.0) feet north of and parallel to the <br />centerline of 13th Street to a point Thirty Three (33.0) feet north of the centerline <br />of 13th Street on the east right -of -way line of Branding Iron Lane; thence north on <br />said east right -of -way line to a point Forty (40.0) feet north of the centerline of <br />13th Street; thence west on a line Forty (40.0) feet north of and parallel to the <br />centerline of 13th Street to the west line of Western Heights Fourth Subdivision; <br />thence north on the west line of Western Heights Subdivision to the point of <br />beginning, all as shown on the plat dated August 10, 2000, attached hereto as <br />Exhibit "A" and incorporated herein by reference. <br />SECTION 3. Said improvement shall be made in accordance with plans and <br />specifications prepared by the Engineer for the City who shall estimate the cost thereof, and <br />submit the same to the City Council, and thereafter, bids for the construction of such sanitary <br />sewer shall be taken and contracts entered into in the manner provided by law. <br />SECTION 4. The cost of construction of such sanitary sewer district shall be <br />assessed against the property within the district abutting upon the easement or other right -of -way <br />within which such sanitary sewer main has been constructed, to the extent of benefits to such <br />property by reason of such improvement, and a special tax shall be levied at one time to pay for <br />such cost of construction as soon as can be ascertained as provided by law; and such special tax <br />and assessments shall constitute a sinking fund for the payment of any warrants or bonds with <br />interest, issued for the purpose of paying the cost of such sewer in such district; and such special <br />Approved as to Form <br />- 2 - August 11, 2000 ♦ City Attorney <br />
