89 -.f 0079 .5 <br />RELINQUISHMENT AND ASSIGNMENT AGREEMENT <br />Dated: May 1, 1985 <br />WHEREAS the undersigned REAL ESTATE DYNAMICS, LTD, a <br />Nebraska limited partnership, .( "REDL") has -heretofore entered <br />into a certain lease dated March 11 1982 with THE COUNTY OF HALL, <br />NEERASatA ( "County ") regarding the following described real <br />property, to -wit: <br />Lots 8 and 9 Westgate Subdivision, Hall <br />County, Nebraska ("Real Estate "); and <br />WHEREAS, the National Bank of Commerce Trust and <br />Savings Association, as Trustee ( "Trustee ") has heretofore <br />succeeded to the County's right to possession of the Real Etiate <br />and to enforcement-of the Lease; and <br />WHEREAS, .Lot 7, Westgate Subdivision,. , Hall County, <br />Nebraska was intended by the County and by REDL to be subject to <br />the Lease; and <br />S�TdEREAS, REDL is in default under the terms of.', tile <br />Learse. <br />In consideration of the mutual agreements contained <br />herei,., the parti6'5 hereto agree as follows: <br />1. REDL agrees that it is in defa -alt under the <br />terms of the Lease; <br />2. R.ML hereby relinquishes to the Trustee its <br />right and claim td• possession of the Real Estate, <br />including said Lot 7, effective as of the date hereof; <br />3. REDL hereby assigns, transfers, and conveys <br />to the Trustee all rights it may have to leases made by <br />REDL, as Lessor, of any part of the Real Estate, <br />L <br />
