<br />KNOW ALL MEN BY THESE PRESENT: That JOSEPH H. BADAPII, Trustee, upon a Deed of Trust
<br />made and entered into on or about June 21, 1982, by and between DONALD C. BATTERSHAW,
<br />r Trustor, and Joseph H. Badami, Trustee and First Federal Savings and Association of
<br />r Lincoln, Beneficiary, of the Register of Deeds office of Hall County, Nebraska, herein
<br />called the GRANTOR, in consideration of Seventeen Thousand One Iiundred and No /100
<br />Dollars ($17,100.00), and other valuable consideration received from Grantee, does
<br />hereby grant, bargain, sell, convey and confirm unto FIRST FEDERAL SAVINGS AND LOAN
<br />ASSOCIATION OF LINCOLN, a United States Corporation, herein called the GRANTEE, the
<br />following described real estate in Hall County, Nebraska:
<br />Lot Seven (7), except the Northerly Four (N4) feet thereof,
<br />In Block Six (6), in the Third Addition to the Village of
<br />Cairo, Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the above - described premises together with all
<br />tenements, hereditament& and apppurtenances thereto belonging unto the Grantee, and-to
<br />Grantee's successors and assigns forever.
<br />Grantor does.he"reby covenant with the Grantee and with the Grantee's•
<br />successors and assigns.

<br />(1) That Donald C. Dattershaw, Trustor, failed to pay the Beneficiary
<br />payments which were contractually due, and the Grantor, at the request of the
<br />Beneficiary, elected to declare the entire unpaid principal balance, together with
<br />interest thereon, at once immediately due and payable.
<br />(2) That a Notice of Default was filed by Gritntdr on November 1, 1988 .in.
<br />Document No. 88- 105874 of the Miscellaneous Records'in •thii Register'of Deeds office ".of
<br />Hall County, Nebraskai. A copy of the Notice of Default was served : UP on Donald C.
<br />Battershaw and Mr. and Mrs. John Doe, by certified mail,-postage'grepaid,.an November
<br />3, 1988.
<br />(3) That Trustor, Donald C. Battershaw, failed to cure the default
<br />referenced in the Notice of Default within 30 days after the service of the Notice of
<br />Default.
<br />(4) That a Notice of Trustee's Sale was filed and a copy of the Notice of
<br />Trustee's Sale was served upon Donald C. Battershaws and Mr. and Mrs. John Doe, by
<br />certified mail, postage prepaid on December 15, 1988.
<br />(5) Grantor published Notice of Trustee -.�'s Sale, to be•he-ld on Wednesday,
<br />the 25th day of January, 1989, at 10 o'clock a.m.." at Grand Island; Hall County,
<br />Nebraska, which Notice was published in Grand Island Independent, Hall County,
<br />Nebraska, once a week for five (5) consecutive weeks, commencing on December 14, 1988,.:,..
<br />and ending on January 11, 1989. The last publication on Notice was at least ten (la!
<br />days prior to the Trustee's Sale, and said sale'wa's not later than- thirty (30) days
<br />after the last publication of Notice.
<br />(6) Grantor conducted the sale of the real property at public auction and
<br />has accepted the bid of First Federal Savings and Loan Association Of-Lincoln in the
<br />sum of Seventeen Thousand One Ifundred and No /100.Dollars ($17,100.06); as the highest
<br />bid upon said real property. Grantor has complied with the requirements of the
<br />above- referenced Deed of Trust and the requirements of Nebraska Statutes, §76 -1001
<br />through §76 -1018, 1965, in the exercise of the sale of the real property described
<br />herein at the Trustee's Sale held on January 25, 1989.
<br />This Deed shall operate to convey to the Grantee, without right of
<br />redemption, the Grantor's title and all right, title, interest and claim of the
<br />Trustor, and his successors in interest and of all persons claiming by, through or
<br />under it, in and to the above- described real property, including all such right,
<br />title, interest and claim in interest subsequent to the execution of the Deed of
<br />Trust.
<br />This Deed is subject to all easements, restrictions or covenants of record,
<br />ihiclt Gran * -or is not entitled to convey pursuant to Nebraska Statute, §76- 1010(2),
<br />I.R.S., 1965.
