<br />INUSTEE'S DEED 89--m 100660
<br />KNOW ALL MEN BY THESE PRESENT: That JOSEPH H. BADAMI, Trustee, upon a Deed of Trust
<br />made and ontored into on or about May 21, 1982, by and between Susie R. Gonzales, Joe
<br />M. Gonzales, and Guillermo Garcia, Trustors, and Joseph II. Bndami, Trustee and first
<br />Federal Savings and Loan Association of Lincoln, Beneficiary, of the Register of Deeds
<br />office of Hall County, Nebraska, herein called the GRANTOR, in consideration of
<br />Nineteen Thousand Seven Hundred and No /100 Dollars ($19,100.00), and other valuable
<br />consideration received from Grantee, does hereby grant, bargain, sell, convey and
<br />confirm unto FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF LINCOLN, A United States
<br />Corporation, herein called the GRANTEE, the following described real estate in Hall
<br />County, Nebraska:
<br />Lot One Hundred Sixty -seven (167) and One Hundred Sixty -eight
<br />(168), Belmont, an Addition to the City of Grand,Island,
<br />Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the above - described premises together with all
<br />tenements, hereditaments and apppurtenances thereto belonging unto the Grantee, and to
<br />Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with the Grantee and with the Grantee's
<br />successors and assigns:
<br />(1) • Tltat.-$usie R. Gonzales, Joe M. Gonzales,' and Guillermo Garcia,
<br />Trustors, fa ted,.td pay the Beneficiary payments which were contractually due, and the
<br />Grantor, at the request of the Beneficiary, elected to declare the entire unpaid
<br />principal balance; tia; ether with interest thereon, at once immediately due and
<br />payable.
<br />(2) That a Notice of Default was filed by Grantor on September 28, 1988 in
<br />Document No. 88- 105208 of the Miscellaneous Records in the Register of Deeds office of
<br />Hall Count,,-,, Nebraska. A copy of the Notice of Default. —Was ser.red upon Susie R.
<br />Gonzales; Estate of Joe M. Gonzales; Guillermo-Garcia; and Mr. Sam Grimminger,
<br />Personal Representative for Glen M. Stewart, by certified mail, postage prepaid, on
<br />September 30, 1988..
<br />(3) That Trustors, Susie R. Gonzales, Joe M. Gonzales, and Guillermo
<br />Garcia, failed to cure the default referenced in the Notice of Default within 30 days
<br />after the service of the Notice of Default.
<br />(4) That a Notice of Trustee's Sale was filed and a copy of the Notice of
<br />Trustee's Sale was served•upon Susie R. Gonzales;.E's 4te of Joe M. Gonzales; Guillermo
<br />Garcia; and-Sam Grimminger, Personal Representative for Glen M. Stewart, by certified
<br />mail, postage prepaid on December 2, 1988.
<br />(5) Gracator published Notice of Trustee's Sale, to be held on Wednesday,
<br />;the 18th day of January, 1489, at 10 o'clock a.am.,•at,Grand Island, Hall County,
<br />Nebraska, which Notice was published in Grand-lslazid Independent, Hall County,
<br />Nebraska, once a week for five (5) consecutive..weeks,.commencing on December 7, 1988,
<br />and ending on January 4, 1989. The last publication on Notice was at least ten (10)
<br />days prior to the Trustee's Sale, and said sale was'not later than thirty (30) days
<br />after the last publication of Notice.
<br />(6) Grantor conducted the sale of the real property at public auction and
<br />has accepted the bid of First Federal Savings and Loan Association of Lincoln in the
<br />sun of Nineteen Thousand Seven Hundred and No /100 Dollars ($19,700.00), as the highest
<br />bid upon said real property. Grantor has complied with the requirements of the
<br />above - referenced Deed of Trust and the requirements of Nebraska Statutes, §76 -1001
<br />through §76 -1018, 1965, in the exercise of the sale of the real property described
<br />herein at the Trustee's Sale held oii January 18, 1989.
<br />This Deed shall operate to convey to the Grantee, without right of
<br />redemption, the Grantor's title and all right, title, interest and claim of the
<br />Trustor, and their successors in interest and of all persons claiming by, through or
<br />tinder it, in and to the above - described real property, including all such right,
<br />title, interest and claim in interest subsequent to the execution of the Deed of
<br />Trust.
<br />This Deed is subject to all easements, restrictions or covenants of record,
<br />which Grantor is not entitled to convey pursuant to Nebraska Statute, §76- 1010(2),
<br />R.R.S., 1965.
