<br />NOTICE IS HEREBY GIVEN that on the =tday of June, 2001, Manufacturers & Traders Trust
<br />Company, One M & T Plaza, Buffalo, New York, 14203 -2399, Trustee for Securitization Series 1999 -3,
<br />Agreement dated 6- 01 -99, by and through its loan servicing agent, Fairbanks Capital Corp., as plaintiff, filed
<br />its Petition in the District Court of Hall County, Nebraska, against Charles E. Leach and Dianna J. Leach, as
<br />defendants, the object and prayer of such Petition being to obtain an accounting, to foreclose a deed of trust
<br />given by said Charles E. Leach and Dianna J. Leach, husband and wife, to Catherine G. Eynard, as Trustee for
<br />the benefit of North American Mortgage Company, Beneficiary, to foreclose any interest in or lien upon the
<br />real estate hereinafter described of the above -named defendants, to obtain an order for the sale of the real estate
<br />hereinafter described for the satisfaction of the indebtedness secured by such deed of trust and to obtain other
<br />equitable relief; that such deed of trust is dated May 7, 1999 and was recorded May 12, 1999, as Instrument
<br />No. 99- 104915 of the Mortgage Records of Hall County, Nebraska, and conveyed to such beneficiary the
<br />following described real estate situated in Hall County, Nebraska, to -wit:
<br />LOT 5, BLOCK,2, EVANS ADDITION AND IT'S COMPLEMENT FRACTIONAL LOT 4,
<br />BLOCK 7, LAMBERTS ADDITION, CITY OF GRAND ISLAND, HALL COUNTY,
<br />NEBRASKA;
<br />that such deed of trust was sold, transferred, and assigned to ContiMortgage Corporation by written
<br />assignment recorded on February 4, 2000, as Instrument No. 0200000996 of the Mortgage Records of Hall
<br />County, Nebraska; and that such deed of trust was sold, transferred, and assigned to the plaintiff by written
<br />assignment recorded on June 15, 2001, as Instrument No. 0200105732 of the Mortgage Records of Hall
<br />County, Nebraska.
