1 <br />�-- �.00�� 7 <br />89-m <br />MORTGAGE ADDENDUM <br />The following are addends to the Mortgage. Please check the applicable addendum. The <br />addendum checked shall be incorporated into, <br />and recorded with, the Mortgage. The term <br />"Mortgage" shall be deemed to include "Deed of Trust," if applicable. <br />XX FMA ADDENDUM <br />As long as the Mortgage is outstanding, the Lender may declare all sums secured by the <br />Mortgage to be immediately due and payable if: <br />(a) all or part of the property is sold or otherwise transferred (other than by <br />devise, descent or operation of law) by <br />Borrower to a purchaser or other• transferee: <br />(i) who cannot reasonably be expected to occupy the property as a <br />principal residence within a reasonable time after the <br />sale or transfer. all as <br />provided in Section .143(c) and 143(1)(2) of the Internal it Code.of 1986. as <br />mended; or <br />(ii) who has had a prevent ownership interest In -a prlmeipat residence <br />:Urfnj, any part of the three -year pe,r.iod ending on the date of the sokeer transfer, <br />Ott as provided in Section 143(d) and 143(1)(2) of the Internal Revenue Code (except <br />that the language "100 <br />percent" shalt be substituted for "95.ptrcent or more" where <br />the latter appears in Section 143(d)(11); <br />or <br />at an acquisition cost which is greater than 90% of the average area <br />purchase price (greater then 110% for targeted ares.residences), all as in <br />provided <br />Section 143(e) and 143(1)(2) of the Internal Revenue Code; or <br />.(iv) who has on income in excess of that estabttshed by the Nebraska <br />Investatent Finance Authority under its applicable regulations <br />or program guidelines <br />in effect on the date of the sale or transfer; or <br />r. <br />(b) ,Borrower fails to occupy the property described in the Mortgage without' <br />Leader's prior written consent; <br />or <br />(c) Borrower omits or misrepresents a material. fact in an application for the <br />References are to the Internal Revenue Code in effect on the date of execution of the <br />mortgage and are deemed to include the implementing-regulations. <br />VA MORTGAGE ADDENDUM <br />If,. so long as the Mortgage is outstanding, all or any part of the property is sold or <br />transferred by Borrower without Lender's <br />.prior written consent. other than a transfer by <br />devise, descent or by operation of taw, the Lender may, at Lender's eption, declare alt the <br />sums secured by the Mortgage to be immediately due and "payable. <br />1 -26 -89 <br />' <br />oats <br />is <br />Borrower Deienfus L.
