KNOW ALL MEN BY THESE PRESENTS, THAT WHEREAS, TIM C.
<br />PLATE, a single person, hereinafter referred to as
<br />"Mortgagor /Trustor" did on the 29th day of December, 1997
<br />execute and deliver to CHARLEY W. FOX a mortgage /Deed of
<br />Trust upon certain real estate located in Hall County,
<br />Nebraska, and legally described as:
<br />Lots B, C and D in Jones Subdivision, Hall County,
<br />Nebraska, commonly known as 409 and 411 W. Louise; 501,
<br />503, 509 and 511 S. Cedar, Grand Island, Nebraska;
<br />conditioned for and to secure the payment of the sum shown
<br />on the NOTE, which mortgage /Deed of Trust was recorded in
<br />the Office of the Register of Deeds of Hall County on the
<br />30th day of December, 1997 as Document No. 97- 110965.
<br />WHEREAS, Mortgagors /Trustors, for the purpose, among
<br />other things, of paying or securing certain debts, have
<br />agreed to execute and deliver a mortgage /Deed of Trust
<br />upon the real estate to Equitable Building and Loan
<br />Association conditioned for the payment of the sum of
<br />ONE HUNDRED FIFTY FIVE THOUSAND to be a first mortgage /deed of
<br />trust upon the premises, recorded in the Register of Deeds
<br />Office as Document No. r-') 6 Do 6 &sS- o
<br />NOW, THEREFORE, CHARLEY W. FOX in consideration of
<br />the premises for value received, the receipt and adequacy
<br />of which is hereby acknowledged, does hereby bargain,
<br />consent, promise and agree to and with
<br />Mortgagors /Trustors, their heirs and assigns, that the
<br />Mortgage /Deed of Trust upon the premises thus to be
<br />executed by Mortgagor /Trustor to Equitable Building and
<br />Loan Association, for the amount and interest above
<br />mentioned, shall at all times be a prior Mortgage /Deed of
<br />Trust and a prior lien upon the premises to the
<br />Mortgage /Deed of Trust of CHARLEY W. FOX as above
<br />described.
<br />IN WITNESS WHEREOF, the undersigned has executed this
<br />Subordination of Mortgage /Deed of Trust on this day
