<br />1. The City of Grand Island, Nebraska, by action of its City
<br />Council on September 26, 1988, enacted Ordinance no. 7496, which
<br />directed the conveyance of the real estate described below and the
<br />manner and terms thereof.
<br />2. Ordinance No. 7496 was published in the Grand Island
<br />Daily Independent according to law, and notice of such sale and the
<br />terms thereof were published in the Grand Island 'Daily Inde-
<br />pendent for three successive weeks, on October 4, October il, and
<br />October 18, 1988, all as required by Section 16 -202, R.R.S. 1943.
<br />3. No remonstrance against such sale was filed with the City
<br />Council of the Cityr�of Grand Island, Nebraska, within thirty days
<br />of the passage and.-publication of Ordinance No. 7496.
<br />4. Section :!6f..ridinance No. 7496 provides that if no
<br />remonstrance be filed against such conveyance, the Mayor and City
<br />Clerk shall •make, execute and deliver to the Grantees a Special
<br />Warranty Deed for said real estate's and the execution of such deed
<br />is hereby authorized without furtA%6r action on behalf of the City
<br />Council.

<br />DOUGLAS C. LUTH and SHERRI L. LUTE,
<br />husband and rifer..as joint tenants and not as tenants i common,
<br />herein called the- Grantees, the following described real property
<br />in Hall County, 'Neb aska:

<br />Pacific Railway Cos Second Addition to Grand Island.;-

<br />This Special Warranty Deed shall convey to Grantees an estate
<br />in fee simple determinable, and in the event of breach of any of
<br />the provisions of paragraph 6 of the foregoing Agreement for
