89-t /00/77 <br />N13TICE OF DEFAULT <br />TO WHOM IT MAY CONCERN: <br />WHEREAS, Edward E. McAleer and Mary W. McAleer, husband <br />and wife, as Trustors, on March 31, 1983, made, executed, and <br />delivered to Stewart Title Guaranty Company, as Trustee, a Deed <br />of Trust covering the following described property, to wit: <br />Lot E1eveh (11), i n: Block Twelve (12), in <br />College Addition to West Lawn in the City? of <br />Grand laland, Hall County, Nebraska. <br />r, ,? •, said Deed of Trust was given as security for <br />the paymeht of A certain note on the same date by Edward E. <br />McAleer and Mary W. McAleer, husband and wife, to Superior <br />Mortgage, Inc., the Beneficiary of said Deed of Trust, which Deed <br />of Trust was recorded on March 31, 1983, in the office of the <br />Register of Deeds, Hall County, Nebraska, as Document No. 83- <br />001523 of the Mortgage Records; and <br />WHEREAS, the said Superior Mortgage, Inc., duly <br />executed a written Assignment of the Deed of Trust to Banco <br />Mortgage Company on April 4, 1983, and thereupon delivered the <br />Deed of Trust and said written Assignment thereof to Banco <br />Mortgage Company in the regular course of business and for a <br />valuable consideration, which Assignment of Deed of Trust was <br />recorded in the office of the Register of Deeds for Hall County, <br />{- <br />Nebraska, on April 19, 1983, as ,Document No. 83- 001908 of the <br />Mortgage Records; - and <br />1= <br />=. EP v the said No -rweas MortganP; Tnc. - fjk /a Banco <br />Mortgage Company, duly executed a written Assignment of the Deed <br />of Trust to The Lomas & Nettleton Company on March 31, 1983, and <br />thereupon delivered the Deed of Trust and said written Assignment <br />thereof to The Lomas & Nettleton Company in the regular course of <br />business and for a valuable consideration, which Assignment of <br />Deed of Trust was recorded in the office of the Register of Deeds <br />for Hall County, Nebraska, on August 28, 1985, as Document No. <br />85- 004144 of the Mortgage Records; and <br />WHEREAS, the said Lomas & Nettleton Company duly <br />executed a Substitution of Trustee on June 20, 1988, removing <br />Stewart Title Guaranty Company as original Trustee. and appointing <br />Kevin L. Reiher as successor Trustee, which'' Substitution of <br />Trustee was recorded in the office of the Register of Deeds for <br />Hall County, Nebraska, on August 19; 1988, as Document No. 88- <br />104576 of the Miscellaneous Records; and <br />WHEREAS, a breach of the obligation for which the trust <br />'{ <br />property was conveyed as security hag occurred, to wit: Edward <br />E. McAleer and Mary W. McAleer, husband and wife, have wholly <br />r <br />failed, neglected, and refused to pay the principal and interest <br />due for the months of November 1987 through January 1989, <br />inclusive, on said note, to the Beneficiary; <br />THEREFORE, notice is hereby given that the undersigned <br />Trustee at the request of the Beneficiary, and in consequence of <br />said default,., has elected to sell, or cause to be sold, the <br />above-described-real estate to satisfy said obligation. <br />-1- <br />J.. <br />
