200006518 <br />The allocated interest in reference to the undivided interest in the <br />common elements and common expenses of the Association have been <br />established upon a formula utilizing the square footage of each unit <br />(exclusive of basements) divided by the total square footage of all units <br />(exclusive of square footage of basements) . If additional units are added <br />to the condominium, the same formula as herein set forth shall govern the <br />allocated interests after an addition in reference to the undivided <br />interests in the common elements and common expenses of the Association. <br />Each unit is entitled to one (1) vote per unit and this formula shall also <br />govern in the event that additional units are added to this condominium. <br />The allocated interests are as follows: <br />Square Foot Area <br />(Excluding Basement) <br />Unit 9 2,208.15 sq. ft. <br />Percentage of Expense in and <br />Rights in Common Elements Votes <br />49.80 <br />1 <br />Unit 10 2,226.52 sq. ft. 50.20 1 <br />ARTICLE VIII. COVENANTS, CONDITIONS, AND RESTRICTIONS <br />The following covenants, conditions, and restrictions relating to <br />this condominium shall run with the land and shall be binding upon all <br />grantees, devisees, mortgagees, and any other persons who use the property, <br />including the persons who acquire the interest of the owner through <br />foreclosure, enforcement of any lien or otherwise: <br />(a) The Indianhead Condominium Unit Owners Association, Inc., <br />a Nebraska non - profit corporation, has been organized and <br />incorporated to provide a vehicle for the management of <br />the condominium that is created in Indianhead Subdivision <br />including any additions of real estate and any units. <br />Each owner of a unit in the condominium shall <br />automatically be deemed a member of the Association. The <br />By -Laws of said Association are also the By -Laws of this <br />condominium property and are attached hereto as Exhibit <br />"B ". As units are added to the condominium, the expenses <br />of the Association shall be allocated as provided in <br />Article III, Section 14 of those By -Laws. <br />(b) The general common elements are for the use and enjoyment <br />of all owners. The limited common elements are for the <br />exclusive use of the owner of the unit or units to which <br />they are appurtenant, their family, guests, servants, and <br />invitees. <br />(c) The ownership of the common elements shall remain <br />undivided, and no person or owner shall bring any action <br />for the partition or division of the common elements. <br />The phrase "common elements" used in this Master Deed and <br />Declaration and amendments thereto shall include both <br />general and limited common elements unless otherwise <br />specified. The Association shall from time to time <br />establish rules and regulations for the use of the common <br />elements, and all owners and users shall be bound <br />thereby. The Association shall have the sole <br />jurisdiction over and responsibility for alterations, <br />improvements, repairs and maintenance of the common <br />elements. The share of an owner in a common element is <br />appurtenant to his or her unit and inseparable from the <br />unit ownership. Assessments against owners for <br />insurance, common elements expenses and reserves, and for <br />other expenses incurred by the Association shall be made <br />pursuant to the By -Laws. Assessments made within ten <br />(10) days after the date when due shall not bear <br />interest, but all sums not paid within said ten (10) day <br />period shall bear interest at the highest legal rate at <br />which individuals may contract under the laws of this <br />state from the due date until paid. If any owner shall <br />fail or refuse to make any payment of such assessments <br />when due, the amount thereof plus interest shall <br />k_1 <br />
