<br />WRITTEN ACKNOWLEDGMENT OF WAIVER
<br />OF HOMESTEAD RIGHTS
<br />The undersigned, prior to signing the attached Trust Deed as
<br />Tr.ustors, in consideration of the extension cf credit by Thomas E. Johns, Sr.,
<br />Eeneficiary of the attached Trust Deed, state as follows:
<br />The undersigned understands that the Trustor has a right to make
<br />designation of homestead in the attached Trust Deed and that the execution of
<br />this statement constitutes a waiver of rights otherwise available for the
<br />purpose of affording the undersigned, as Trustor, the opportunity to retain his
<br />or her homestead in the event of default upon the attached Trust Deed. This
<br />waiver includes a waiver of any right to designate a homestead interest in any
<br />of the real estate described in the attached Trust Deed.
<br />The undersigned, whether one or more, acknowledge this waiver is
<br />their voluntary act and deed and constitutes a written waiver under the Farm
<br />Homestead Protection Act and waives any right to defer selection of homestead
<br />rights.
<br />The undersigned further understands and agrees that this waiver
<br />shall be filed as a preface to a Trust Deed with the Register of Deeds.

<br />This Trust Deed made this -7-2"day of August, 2000 between Thomas
<br />E. Johns, II, and Iris Leora Johns, husband and wife, as Trustor, whether one
<br />or more, whose address is 2519 West lst Street, Grand Island, NE 68803, and
<br />Thomas S. Kruml as Trustee, whose address is 1545 M Street, P.O. Box 40, Ord,
<br />NE 68862, and Thomas E. Johns, Sr., as Beneficiary, whether one or more, whose
<br />address is Box 82, Burwell, NE 68823.
<br />WHEREAS, Trustor conveys, sells, and warrants to Trustee in trust,
<br />with power of sale, the following described real property:
<br />Lot 11, in Block 12, in Ashton Place, an Addition to the City of
<br />Grand Island, Hall County, Nebraska.
<br />The intention being to convey hereby an absolute title in fee
<br />simple, together with all buildings, fixtures, improvements and appurtenances,
<br />easements, rents, issues, profits, reversions, and remainders thereunto
<br />belonging, it being agreed that all of the foregoing shall hereinafter be
<br />referred to as the "Property ".
