O'CONNOR and JENNIFER O'CONNOR, as <br />joint tenants with rights of survivorship, GRANTEE, the receipt and sufficiency of which is <br />hereby acknowledged, conveys to GRANTEE the real estate (as defined in Neb. Rev. Stat. 76- <br />201) known as the Ile de Grand Shopping Center, Grand Island, being more particularly <br />described in Exhibit A attached hereto and made a part hereof for all purposes, together with all <br />improvements and fixtures situated thereon, <br />GRANTOR covenants (jointly and severally, if more than one) with GRANTEE that <br />GRANTOR: <br />(1) is lawfully seised of such real estate; <br />(2) has legal power and lawful authority to convey the same; and <br />(3) warrants and will defend title to the real estate against the lawful claims of all <br />persons claiming the same or any part thereof through, by or under Grantor. <br />Said premises are conveyed subject to and with the benefit of all easements, agreements, <br />covenants, conditions, rights and restrictions of record to the extent the same are in force and <br />applicable, including those set forth on Exhibit B attached hereto. <br />Said premises are also sold subject to real estate taxes and assessments assessed for calendar <br />years 2000 and 2001 which are not yet due and payable, which by the acceptance and recording <br />of this deed the GRANTEE assumes and agrees to pay. <br />GRANTOR intends to convey to GRANTEE all of GRANTOR'S interest in the property.
