NE- ZAAU -HA- 031000 <br />SUITE 18 DRAFT NO.: <br />TWIN FALLS, ID 83301 <br />AMENDMENT TO GRANT <br />PARTIES: AT &T Corp, successor to American Telephone and Telegraph Company, <br />as Agent, (hereinafter referred to as "AT &T ") <br />REGARDING: This document amends paragraph three (3) of the addendum to the "Grant ". <br />dated July 16, 1987, recorded July 23, 1987 as <br />Document No. 87- 105860 in Hall County, State of Nebraska. <br />THAT WHEREAS, AT &T is the owner of an easement upon, over and under a strip of land 16.5 feet wide more particularly <br />described in the above - referenced "Grant" and AT &T agrees to redefine the 16.5 foot easement that traverses the parcel of land <br />By: Angeline R. and Peter A. Dibbem. <br />NOW, THEREFORE, the 16.5 foot wide easement will be over the existing easement and include the right to construct, <br />reconstruct, operate, maintain (to include aerial patrol), alter, replace and remove such communications systems. This <br />Amendment grants to AT &T CORP, the right to extend the description of AT &T CORP as "Grantee" to it's associated and allied <br />companies, its and their successors, assigns, lessees and agents. This amendment is for the EXISTING SYSTEM and the <br />NEXGEN communications project. Additional systems that may be required after the NEXGEN project will not be included in <br />this amendment. It is understood that the placement of cables within the vacant conduits may take place at a future date but are <br />part of the NEXGEN Communications Project. In addition, the conditions in the addendum that is in effect pursuant to the prior <br />easement to AT &T dated July 16,1987 for this same property shall continue and apply to this amendment as well, except for <br />what this amendment provides for and agreed to by Grantor and Grantee. Grantor in the addendum dated July 16, 1987 shall <br />include their successors, assigns, lessees and agents. <br />THIS AMENDMENT shall not subtract from AT &T's enjoyment of its other remaining rights on said 16.5 foot wide easement <br />strip and therefore, such rights shall remain in full force and effect in every respect for both parties.
