The Trustor hereby conveys, sells and warrants to the Trustee, in trust, with <br />power of sale, the following described real estate: <br />A tract of land located in the NEl /4 of Section 36, Township 10 North, Range 11 West of the 6th P.M., <br />Hall County, Nebraska, more particularly described as follows: Commencing at the East' /4 corner of <br />said Section 36; thence N00 °00'E (assumed bearing) along the East line of said Section 36 and the <br />centerline of a county road, a distance of 405.41 feet; thence N90 °00'W, a distance of 33.0 feet to a <br />point on the West right of way line of said county road, said point also being the point of beginning; <br />thence continuing N90 °00'W, a distance of 400.00 feet; thence N00 °00'E a distance of 446.37 feet to a <br />point on the Southerly right of way line of Interstate 80; thence S 69 °54'50 "E a distance of 425.9 feet <br />along said Southerly right of way line of Interstate 80; thence S00 °00'W along the said West right of <br />way line of a county road, a distance of 300.00 feet to the point of beginning; and <br />Lot One (1), 3 -13 Ammunition Subdivision to the Village of Doniphan, Hall County, Nebraska; <br />the intention being to convey hereby an absolute title in fee simple, together with all buildings, fixtures, <br />improvements and appurtenances thereunto belonging. <br />The Trustor covenants and agrees with the said Trustee and Beneficiary that it is lawfully seized <br />of said premises; that Trustor has good, right and lawful authority to sell and convey said premises; that <br />said premises are free and clear of all liens and encumbrances; and that Trustor will warrant and defend <br />title to said premises unto the Trustee and its successors and assigns forever against the claims of all <br />persons. <br />2. Trustor's Primary Obligation: For the purpose of securing performance of each <br />agreement of Trustor herein contained and the payment of One Hundred Thousand Dollars ($100,000.00), <br />upon the terms set forth in a written Promissory Note bearing even date herewith. <br />3. Trustor's Secondary Rights and Duties: While title is vested in Trustee and until filing of <br />Notice of Default, the Trustor shall: <br />A.
