PAVELKA, JR., is the <br />Trustee under a Deed of Trust made and entered into on or about December 7, 1998, by and between <br />LORI ANN KOLAR and TIMOTHY A. KOLAR, wife and husband, SANDRA M. KOENIG, <br />Trustee, and NORTH AMERICAN MORTGAGE COMPANY, Beneficiary. Said Deed ofTrust <br />was recorded in the office of the Register of Deeds of Hall County, Nebraska, and recorded on <br />December 15, 1998, as Instrument No. 98- 112372 of the Mortgage Records of Hall County, <br />Nebraska, and assigned to CONTIMORTGAGE CORPORATION by Assignment dated <br />December 17, 1998, and filed for record on March 17, 1999, as Instrument No. 99- 102756 of the <br />Mortgage Records of Hall County, Nebraska. DONALD J. PAVELKA, JR. has been appointed as <br />Trustee, replacing Sandra M. Kong by virtue of a Substitution of Trustee dated March 27, 2000, <br />and filed for record on March 31, 2000, as Instrument No. 0200002488 ofthe Miscellaneous Records <br />of Hall County, Nebraska. Donald J. Pavelka, Jr., Grantor, in consideration of the sum of Ninety - <br />One Thousand and 00 /100 Dollars ($91,000.00) and other good and valuable consideration received <br />from CONTIMORTGAGE CORPORATION, does hereby grant, bargain, sell, convey and confirm <br />unto ContiMortgage Corporation (hereinafter "Grantee" where appropriate), the following - <br />described real property in Hall County, Nebraska, to wit: <br />Lot One (1) BILLY POE SUBDIVISION, Hall County, Nebraska, <br />to have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. <br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />That Lori Ann Kolar and Timothy A. Kolar, as Trustor, failed to pay to Beneficiary payments <br />which were contractually due, and the Grantor, at the request of the Beneficiary, elected to <br />declare the entire unpaid principal balance, together with interest thereon at once immediately <br />due and payable. <br />2. That a Notice of Default as required by § 76 -1006 was filed by Grantor on April 13, 2000, as <br />Instrument No. 0200002986 of the Miscellaneous Records in the office of the Register of <br />Deeds of Hall County, Nebraska. A copy of said Notice of Default was thereafter mailed to <br />all parties entitled to notice, pursuant to said Deed of Trust and in compliance with § 76- <br />1008, R.R.S. Nebraska. <br />That the Trustor failed to cure the default referenced in the Notice of Default within 30 days <br />after filing of the Notice of Default. <br />4. That a Notice of Trustee's Sale was filed by Grantor on May 22, 2000, as Instrument No. <br />0200004151 of the Miscellaneous Records in the office of the Register of Deeds of Hall <br />County, Nebraska. A copy of said Notice of the time and place of the sale was thereafter <br />mailed to all parties entitled to notice pursuant to said Deed of Trust and in compliance with § <br />76 -1008, R.R.S. Nebraska. <br />That Grantor as required by § 76 -1007 published Notice of Trustee's Sale to be held on July <br />13, 2000, at 11:00 a.m. in the lower lobby of the Hall County Courthouse, 111 West First <br />Street, Grand Island, Nebraska. Said Notice was published in The Grand Island Independent, <br />a legal newspaper of Grand Island, Hall County, Nebraska, once a week for five consecutive <br />weeks commencing on May 22, 2000, and ending June 19, 2000.
