All that part of Lot One (1), Block Eight (8), Arnold & Abbott's
<br />Addition to the City of Grand Island, Hall County, Nebraska and
<br />that part of vacated Clark Street as shown in Ordinance No. 6579,
<br />all lying North of the North Right of Way of the Union Pacific
<br />Railroad Right of Way.
<br />This conveyance is made pursuant to the powers conferred on Grantor by a Deed of
<br />Trust dated February 3, 1998, and recorded on February 6, 1998, in the Register of Deeds
<br />Office of Hall County, Nebraska as Document No. 98- 101005 wherein Ross A. Racek, single,
<br />is Trustor, and Lori Ann Kolar, a married woman, is named Beneficiary, and said beneficial
<br />interest later assigned to Timothy Allen Kolar as beneficiary, and Duane A. Burns, Attorney
<br />at Law is named Trustee; and in such Trust Deed, the Trustor granted and conveyed to
<br />such Trustee, on the trust therein expressed, the property above - described to secure, among
<br />other obligations, payment of a promissory note of even date in the principal amount of
<br />$6,000.00; and after the fulfillment of the conditions specified in the Deed of Trust
<br />authorizing this conveyance as follows:
<br />(1) Breach and default were made under the terms of the Deed of Trust in the
<br />particular set forth in the notice of default hereinafter referred to, which default continued
<br />until the time of sale.
<br />(2) There was filed for record on May 2, 2000, as Document No. 0200003566 a notice
<br />of default in the Register of Deeds Office of Hall County, Nebraska, and of election to sell
<br />the property to satisfy the obligations secured thereby and thereafter notice of the filing of
<br />the notice of default was sent in the statutory manner to all persons entitled to a notice
<br />thereof, namely Ross A. Racek, by certified mail, return receipt requested on May 5, 2000,
<br />and to Cheryl Lynn Racek in care of her attorney, Gregory D. Barton.
<br />(3) That thereafter, the Grantor executed his notice of trustee's sale, stating that he
<br />would sell at public auction to the highest bidder the property hereinbefore described,
<br />fixing the time and place of the sale as July 14, 2000 at 10:30 a.m. at the lower lobby of the
<br />county courthouse in Grand Island, Hall County, Nebraska, and caused copies of such
<br />notice to be published once a week for five consecutive weeks in the GRAND ISLAND
<br />DAILY INDEPENDENT, a legal daily newspaper printed, published and of general
<br />circulation in the County of Hall, Nebraska, the first date of publication being on June 5,
<br />2000 and the last day of publication being July 3, 2000; and notice of such trustee's sale was
<br />sent to the Trustors and all persons entitled to notice thereof in accordance with applicable
<br />law. The notice of trustee's sale was mailed to Ross A Racek by certified mail, return receipt
<br />requested on June 6, 2000.
<br />(4) All applicable statutory provisions of the State of Nebraska and the United States
<br />of America and all provisions of such Deed of Trust have been complied with as to acts to
<br />be performed and notices to be given.
