No remedy herein conferred upon or reserved to Trustee or Beneficiary is <br />intended to be exclusive of any other remedy herein or permitted or provided by law, but each shall <br />be cumulative and shall be in addition to every other remedy given hereunder or now or hereafter <br />existing by law or in equity or by statute. Nothing herein shall be construed as prohibiting Beneficiary <br />from seeking a deficiency judgment against the Trustor to the extent such action is permitted by law. <br />19. Request for Notice. Trustor hereby request a copy of any notice of default or of notice of sale <br />hereunder be mailed to them at the address set forth in the first paragraph of this Trust Deed. <br />20. Notice s. Whenever Beneficiary, Trustor, or Trustee shall desire to give or serve any notice, demand, <br />request or other communication with respect to this Trust Decd, each such notice, demand, request <br />or oQrer communication shall be in writing and shall be effective only if the same is delivered by <br />personal service or mailed by certified mail, postage prepaid, addressed to the address set forth in the <br />beginning of this Trust Deed, or in any request for notice, or change of address given as provided by <br />law. <br />21. W�vtr of IJomestead j 'l r . The undersigned hereby waives any right to make a designation of <br />homestead in the Property or any part thereof, and disclaims designation of homestead in the Property <br />or any part thereof, and disclaims any right to make a designation of homestead in the future in the <br />Property or any pan thereof so long as the Trust Deed remains a lien on the Property. <br />22, Trustee's Fee. In the event of default, unless specifically waived ut writing by Trustee, Trustor agree <br />to pay Trustee a fee equal to $250.00, or one -half of one percent of the entire unpaid principal sum <br />secured, which ever is greater, subject to the limits ofNeb. Rev. Star. § 16 -1012, as amended. <br />23. Right to Reinstate. If Trustor meet certain conditions, Trustor shall have the right to have enforcement <br />of this Trust Deed discontinued at any time and in the manner provided by Neb. Rev. Stat. § 76 -1012, <br />as now or hereafter amended. <br />24. Reconvcv_ t e. On satisfaction of all of Trustors' obligations under this Trust Deed and the Trust <br />Deed Note, and on written request of Beneficiary stating that all sums secured hereby have been paid, <br />and on surrender of this Trust Deed and the Trust Deed Note to Trustee for cancellation, 'Trustee shall <br />reconvey to Trustor or the person or persons legally entitled thereto, without warranty, any portion of <br />the Property then held hereunder. The recitals in any such reeonvcyanee of any matters or facts shall <br />be conclusive proof of the truthfulness thereof. <br />25. lavalid'b of ' ain Provisions. If the lien of this Trust Deed is invalid or unenforceable as to any <br />part of the debt, or if the lien is invalid or unenforceable as to any part of the Property, the unsecured <br />or partially secured portion of the debt shall be completely paid prior to the payment of the remaining <br />and secured or partially secured portion of the debt, and all paymonts made on the debt, whether <br />PAGE 9 OF 1 I PAGES <br />
