06/04/2001 14;30 308 -234 -4218 TVRDIK LAW OFFICE PAGE 06 200105298 (b) No provision of this Trust Deed shall require Trustee to expend or risk Trustee's own funds or otherwise incur any financial obligation in the performance of any of the Trustee's duties herein, or in the exercise of any of Trustee's rights or powers if Trustee shall have grounds for believing that assurance of the repayment of such funds is uncertain; (c) Trustee may consult with counsel of Trustee's own choosing and the advice of such counsel shall be full and complete authorization and protection in respect to any action taken or suffered by Trustee hereunder in good faith and in reliance upon such advice; (d) Trustee shall not be liable for any action taken by Trustee in good faith and reasonably believed by Trustee to be authorized or within the discretion or rights or powers conferred upon, Trustee by this Trust Deed. 15. Events of Default. Any of the following events shall be deemed an event of default under this Trust Deed: (a) Trustor shall have failed to perform any covenant by Trustor to be performed herein or there has occurred a breach or default on the part of Trustor of or under any term, covenant, agreement, condition, provision, representation or warranty contained in this Trust Deed or the Trust Deed Note; or (b) Trustor shall have failed to pay any installment due on the Note secured hereby on or before the due date thereof; or (C) Trustor shall file a voluntary petition in bankruptcy or shall be adjudicated a bankrupt or insolvent, or shall file any petition or answer seeking or acquiescing in any reorganization, arrangement, composition, or restructure of indebtedness or similar relief for himself under any present or future Federal, State, or other statute, law, or regulation relating to bankruptcy, insolvency or other relief for debtors; or shall seek or consent to or acquiesce in the appointment of any trustee or receiver of Trustor or of all or any part of the Property, or of any or all the revenues, rents, issues or profits thereof, or shall make any general assignment for the benefit of creditors, or shall admit in writing his inability to pay his debts as they become due; or (d) Trustor shall have sold or encumbered the Property in violation of paragraph "11. Transfer of PigpgrW' herein; or (e) A writ of execution or attachment or any similar process shall be entered against Trustor which shall become a lien on the Property or any portion thereof or interest therein and such execution, attachment, or similar process of judgment is not released, bonded, satisfied, vacated or stayed within sixty days after its entry or levy; or PAGE 6 OF 11 PAGES
