06/04/2001 14;30 308 -234 -4218 TVRDIK LAW OFFICE PAGE 06 <br />200105298 <br />(b) No provision of this Trust Deed shall require Trustee to expend or risk Trustee's own funds <br />or otherwise incur any financial obligation in the performance of any of the Trustee's duties <br />herein, or in the exercise of any of Trustee's rights or powers if Trustee shall have grounds <br />for believing that assurance of the repayment of such funds is uncertain; <br />(c) Trustee may consult with counsel of Trustee's own choosing and the advice of such counsel <br />shall be full and complete authorization and protection in respect to any action taken or <br />suffered by Trustee hereunder in good faith and in reliance upon such advice; <br />(d) Trustee shall not be liable for any action taken by Trustee in good faith and reasonably <br />believed by Trustee to be authorized or within the discretion or rights or powers conferred <br />upon, Trustee by this Trust Deed. <br />15. Events of Default. Any of the following events shall be deemed an event of default under this Trust <br />Deed: <br />(a) Trustor shall have failed to perform any covenant by Trustor to be performed herein or there <br />has occurred a breach or default on the part of Trustor of or under any term, covenant, <br />agreement, condition, provision, representation or warranty contained in this Trust Deed or <br />the Trust Deed Note; or <br />(b) Trustor shall have failed to pay any installment due on the Note secured hereby on or before <br />the due date thereof; or <br />(C) Trustor shall file a voluntary petition in bankruptcy or shall be adjudicated a bankrupt or <br />insolvent, or shall file any petition or answer seeking or acquiescing in any reorganization, <br />arrangement, composition, or restructure of indebtedness or similar relief for himself under <br />any present or future Federal, State, or other statute, law, or regulation relating to bankruptcy, <br />insolvency or other relief for debtors; or shall seek or consent to or acquiesce in the <br />appointment of any trustee or receiver of Trustor or of all or any part of the Property, or of any <br />or all the revenues, rents, issues or profits thereof, or shall make any general assignment for <br />the benefit of creditors, or shall admit in writing his inability to pay his debts as they become <br />due; or <br />(d) Trustor shall have sold or encumbered the Property in violation of paragraph "11. Transfer <br />of PigpgrW' herein; or <br />(e) A writ of execution or attachment or any similar process shall be entered against Trustor <br />which shall become a lien on the Property or any portion thereof or interest therein and such <br />execution, attachment, or similar process of judgment is not released, bonded, satisfied, <br />vacated or stayed within sixty days after its entry or levy; or <br />PAGE 6 OF 11 PAGES <br />
