<br />CORNHUSKER ARMY AMMUNITION PLANT
<br />HALL COUNTY, NEBRASKA
<br />THE SECRETARY OF THE ARMY under and by virtue of the authority vested in the
<br />Secretary by Title 10, United States Code, Section 2668, and pursuant to Public Law 103 -337, 108
<br />Stat 2663, 3063, having found that the granting of this easement will not be against the public interest,
<br />hereby grants to THE CITY OF GRAND ISLAND, a political subdivision of the State of Nebraska,
<br />hereinafter referred to as the grantee, an easement and right -of -way for a public recreational trail,
<br />hereinafter referred to as the facilities, over, across, in and upon the lands of the United States as
<br />identified in Exhibit "A ", attached hereto and made a part hereof, hereinafter referred to as the
<br />premises.
<br />THIS EASEMENT is granted subject to the following conditions:
<br />1. NATURE OF EASEMENT
<br />Pursuant to this easement for public recreational trail, the grantee shall have the right to
<br />plan, design, construct, maintain, operate, repair and protect a public recreational trail over,
<br />across, in and upon the lands previously described above. Further, the grantee shall have the right
<br />to prohibit others from disturbing, damaging or removing trees, shrubs and vegetation on the
<br />premises and may replace any trees, shrubs and vegetation which become diseased or damaged, or
<br />that are removed or die during the term of this easement. The grantee shall also have the right to
<br />plant additional trees, shrubs and vegetation on the premises to enhance the esthetic qualities of
<br />the recreational trails and to erect fences or barriers to protect the premises.
