D T S D ►O' ° CD M c+ C= N rat Z^ _ c. � m p —!fie = D p x m -c z o ° CD n i `^ "C_� o Q m �� M m � fir— D CIl h CD Q Ca !D O® (or) ~ O DEED OF TRUST MODIFICATION AGREEMENT (Variable Rate to Fixed) THIS DEED OF TRUST MODIFICATION AGREEMENT made and executed this 11th day of MAY, 2001, by and between KAREN J ENGLER, A SINGLE PERSON , hereinafter referred to as `Borrower ", and HOME FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, hereinafter referred to as "lender ", WITNESSETH: WHEREAS, Borrower did execute a certain Adjustable Rate Note payable to the order of the Lender in the total original amount of FORTY ONE THOUSAND AND NO /100 Dollars ($41 0, 00.00); WHEREAS, the Note described above was secured by a Deed of Trust with Adjustable Rate Rider dated OCTOBER 28, 1994, filed of record in the Office of the Hall County Register of Deeds on OCTOBER 28, 1994 as Document No. 94- 108807 in respect to that real estate described as: SUITE NO.- TW012) ALLENE T_y ___ ._ REGIME, BEING PART OF UNIT ONE, LOT TWO (2), BLOCK EIGHT (8) REPLAT, CONTINENTAL GARDENS, AN ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA; AND GARAGE "T' IN "D" WINDSOR SQUARE CONDOMINIUM PROPERTY REGIME UNIT FOUR (4), LOT TWO (2), BLOCK EIGHT (8), REPLAT OF CONTINENTAL GARDENS, AN ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA WHEREAS, Borrower has requested that interest be converted to a fixed rate rather than the variable rate specified by such Deed of Trust with Adjustable Rate Rider and that the stated maturity date be also hereby modified; WHEREAS, Lender is willing to convert such variable rate loan into a fixed rate loan to be secured by such Deed of Trust with Adjustable Rate Rider and modify the existing maturity date; WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust with Adjustable Rate Rider identified hereinabove to provide that it shall continue to secure the presently remaining indebtedness from and after the date hereinafter specified together with a fixed rate of interest rather than a variable rate as originally set forth in such Adjustable Rate Rider; NOW, THEREFORE, it is agreed: 1. Interest Rate and Maturity Modification. Commencing effective JUNE 1200 1, the indebtedness secured by the Deed of Trust with Adjustable Rate Rider hereinabove identified shall accrue interest at a fixed rate of SEVEN & THREE EIGHTHS percent (7.375 1/o) throughout the remaining term of such indebtedness and, notwithstanding the provisions contained in the Adjustable Rate Rider, there shall be no further adjustments to such interest rate. The final maturity of such indebtedness as modified, secured by such Deed of Trust shall be MAY 1, 2011, notwithstanding any other date of maturity which may have been specified in the Deed of Trust hereinabove identified. //• et-0
