<br />AVIGATION AND HAZARD EASEMENT
<br />WHEREAS, Herman E. Elstermeier, a single person, and Robin E.
<br />Elstermeier and Janet L. Elstermeier., husband and wife, hereinafter
<br />called the Grantors, are the owners in fee of that certain parcel
<br />of land situated in the County of Nall, State of Nebraska, more
<br />particularly described as follows:
<br />A tract of land in the SE 1/4, Section 36, Township 12
<br />North, Range 9 West of the 6th P.M., Hall County,
<br />Nebraska, and described as follows: Beginning at the
<br />S1 /4 corner of Section 36, T12N, R9W, having an assumed
<br />bearing of NOio15101 "W a distance of 1375.93' to the
<br />intersection of the extended centerline of runway 13/31
<br />and the West line of the SE1 /4 of Section 36 with said
<br />intersection being 1126.47' SE of the end of runway
<br />13/31; thence S45o49'25 "E a distance of 773.53' along the
<br />extended centerline of runway 13/31 to the end of the
<br />clear zone fan; thence N44n1013511E a distance of 164.52'
<br />along the end of the clear zone fan to the intersection
<br />of the East line of the W1 /2 of the W1 /2 of the SE1 /4
<br />being the point of beginning; thence N01o12' 17 "W along
<br />the East line a distance of 415.68' to the edge of the
<br />clear zone fan; thence S54 ol.1' 23 "F a distance of 299.06' ;
<br />thence S44010'35 "W a distance of 335.46' to the point of
<br />beginning, containing 1.14 acres more or less. W �S
<br />NOW, THEREFORE, in consideration of the sum of HUNDRED
<br />DOLLARS ( and other good and valuable consideration, the
<br />receipt �° sufficiency of which is hereby acknowledged, the
<br />Grantors, for themselves, their heirs, administrators, executors,
<br />successors and assigns, do hereby grant, bargain, sell and convey
<br />unto Hall County Airport Authority, hereinafter called the Grantee,
<br />its successors and assigns, for the use and benefit of the public,
<br />an easement. and right of way, appurtenant to Central Nebraska
<br />Regional Airport for the unobstructed use and passage of all types
<br />of aircraft (as hereinafter defined), in and through the airspace
<br />above Grantors' property plane to an infinite height above the
<br />surface of the land.
<br />Said casement shall be appurtenant to and for the benefit of
<br />the real property now known as Central Nebraska Regional. Airport
<br />including any additions thereto wherever located, hereafter made by
<br />Central Nebraska Regional Airporu or its successors and assigns,
<br />guests, and invitees, including any and all persons, firms, or
<br />corporations operating aircraft to or from the airport.
<br />Said easement and burden, together with all things which may
<br />be alleged to be incident to or resulting from the use and
