DEED OF TRUST 2 0 0 0 C 5 2 71- <br />This DEED OF TRUST is made this 16th day of June, 2000, by and among ALOYSIUS R. <br />PANOWICZ (a/k/a AL R. PANOWICZ) and EVELYN D. PANOWICZ, husband and wife, hereinafter <br />referred to as " Trustors," whether one or more, whose mailing address is 7251 West Nebraska Highway 2, <br />Grand Island, Nebraska 68803, THE STATE BANK OF CAIRO, a Nebraska Banking Corporation, <br />hereinafter referred to as "Trustee," whose mailing address is Box 428, Cairo, Nebraska 68824; and THE <br />STATE BANK OF CAIRO, a Nebraska Banking Corporation, hereinafter referred to as "Beneficiary," <br />whose mailing address is Box 428, Cairo, Nebraska 68824. <br />For valuable consideration, Trustors irrevocably grant, transfer, convey and assign to Trustee, in trust, <br />with power of sale, for the benefit and security of Beneficiary, under and subject to the terms and conditions of <br />this Deed of Trust, the following described real property located in HALL County, Nebraska: <br />The Southwest Quarter (SW 1/4) of Section Twenty Two (22) in Township Twelve (12) North, Range <br />Eleven (11) West of the 6th P.M., Hall County, Nebraska, except tract deeded to the State of Nebraska <br />by Deed recorded in Book 85 at Page 10, subject to the right of way of the Grand Island and Wyoming <br />Central Railroad Company; and <br />A tract of land located in the Northwest Quarter of the Southeast Quarter (NW 1/4 SE 1/4) of Section <br />31, Township 12 North, Range 10 West of the 6th P.M., Hall County, Nebraska, described as: <br />Commencing at the Northeast corner of the Northwest Quarter of the Southeast Quarter of Section 31, <br />and proceeding in Westerly direction along and upon the North line of the Northwest Quarter of the <br />Southeast Quarter a distance of 330 feet; thence proceeding South parallel to the West line of Section 31, <br />a distance of 330 feet; thence proceeding Easterly parallel with the South line of Section 31, a distance of <br />330 feet; thence proceeding North along and upon the East line of the Northwest Quarter of the <br />Southeast Quarter Section 31, a distance of 330 feet to the point of beginning; and <br />The Southwest Quarter (SW1 /4) and West Half of the Southeast Quarter(W1 /2SE1 /4), Section <br />Thirty -One (31), Township Twelve (12) North, Range Ten (10), West of the 6th P.M., Hall County, <br />Nebraska, excepting therefrom the rectangular tract of 73.5 acres devised under the Will of James B. <br />Lesher, deceased, to Rosa Starr, which 73.5 acres are more particularly described as a rectangular tract <br />with the South line of the SE 1/4 and the W 1/2 of the SE 1/4 as its South boundary line, said tract being <br />conveyed containing 148.5 acres, subject to highway right of way and easements for pipeline granted to <br />Kansas Nebraska Gas Company; and <br />T.W5 171-0 i4 .j,l),1ia '01/ 9). Gli �Il <br />.. a i ol; ,nr : •'I' .� ; 4'IE i, 111.' 11. �, i'.11'I /.. y , e �•� 1 :i._ : ; `,i.4 �.�; <br />together with all buildings, improvements, fixtures, streets, alleys, passageways, easements, rights, privileges and <br />appurtenances located thereon, and all personal property that may be or hereafter become an integral part of such <br />buildings and improvements, all crops raised thereon, and all water rights, all of which, including replacements <br />and additions thereto, are hereby declared to be a part of the real estate conveyed in trust hereby, it being agreed <br />that all of the foregoing shall be hereinafter referred to as the "Property." <br />FOR THE PURPOSE OF SECURING: <br />a. Payment of indebtedness evidenced by Trustors' note of even date herewith in the principal sum of <br />$50,000.00, together with interest at the rate or rates provided therein, and any and all renewals, modifications <br />and extensions of such note, both principal and interest on the note being payable in accordance with the terms <br />set forth therein, which by this reference is hereby made a part hereof, <br />b. The performance of each agreement and covenant of Trustors herein contained; and <br />c. The payment of all sums advanced by Beneficiary under the terms of this Deed of Trust, together with <br />interest thereon at the rate provided in the note. <br />d. The above amount is secured even though all or part of it may not yet be advance. Future advances under <br />the agreement are contemplated and will be secured to the same extent as if made on the date this deed of trust is <br />executed. <br />TO PROTECT THE SECURITY OF THIS DEED OF TRUST, TRUSTORS HEREBY COVENANT AND AGREE: <br />1. To pay when due, the principal of, and the interest on, the indebtedness evidenced by the note, charges, fees and all other <br />sums as provided in the loan instruments. <br />2. Trustors are the owners of the property and have the right and authority to execute this Deed of Trust in respect to the <br />property. <br />
