v <br />For Official Use OnI <br />DEED OF TRUST <br />rn <br />CD <br />CD <br />CIO <br />A <br />co <br />O <br />0 <br />DEED OF TRUST <br />THIS DEED OF TRUST is made on May 16, 2001.\ <br />The Trustor is CUONG XUAN NGUYEN and HANG NGOC HO, husband and wife, a/k/a Borrower, whether one or <br />more. <br />The Trustee is CHARLES CUYPERS, City Attorney. <br />The Beneficiary is THE CITY OF GRAND ISLAND, NEBRASKA, a municipal city corporation, a/k/a Lender. <br />Borrower irrevocably conveys to Trustee, in trust, with power of sale, the following: <br />Lot Three (3), Lincoln View Estates Subdivision in the City of Grand Island, Hall County, Nebraska. <br />Together with all the rents and profits therefrom and subject to easements and restrictions of record, if any. <br />Borrower owes Lender Nine Thousand ($9,000), evidenced by Borrower's note of even date, payable according to <br />the terms thereof. <br />This Security instrument secures to Lender the Debt evidenced by said note, the payment of all other sums, with <br />interest, advanced under the provisions hereafter to protect the security and the performance of Borrower's <br />covenants and agreements. <br />Borrower covenants that Borrower is lawfully seised of such real estate and has the legal power and lawful authority <br />to convey the same and warrants and will defend title to the real estate against the lawful claims of all persons. <br />This Deed of Trust shall be deemed subordinate to the Deed of Trust between the Borrower and United Nebraska <br />Bank of Grand Island executed on May 16, 2001, which secures the balance of the debt for the purchase of the <br />above described real estate and the Deed of Trust between the Borrower and the City of Grand Island, Nebraska, a <br />municipal corporation executed on May 16, 2001, which secures the debt in the amount of $10,700.00 from the <br />City's Down Payment Assistance Program. <br />BORROWER AND LENDER AGREE AS FOLLOWS: <br />Borrower shall pay when due, the principal and interest as provided in said note. <br />2.
